Notwithstanding the date on which the Agreement comes into effect, if from the date of this Agreement there is any repeal or amendment to the APCO (other than pursuant to the Government’s proposal to amend the APCO to cap the emissions of the Pollutants and to facilitate the use of emissions trading as described in a Legislative Council Panel on Environmental Affairs Paper reference CB(1) 418/07-08(07) dated 17 December 2007 (“Legislative Proposal”)) or any renewal of or change to any Specified Process Licence (other than to the amount of the Initial Cap or pursuant to the Legislative Proposal), which has a material effect on the Mechanism or HEC’s emissions performance or compliance with the Total Permissible Emissions, the Mechanism shall not apply to that Applicable Year and any subsequent Applicable Years until HEC and the Government have reached agreement as to the amendments to this Schedule that are required to give continued effect to the Mechanism.

The Executive Committee may wish to take note of the verification and progress reports on the implementation of the national CFC phase-out plan (NPP) for Argentina, and approve the annual implementation programme for 2008-2009 with a proviso requesting the Government of Argentina and UNIDO to ensure that future verification will include the country’s monitoring of its activities under the Agreement through the monitoring institutions defined in Appendix 5-A of the Agreement.

One delegation highlighted water scarcity and drought in some member countries, which would also require efficient water resource management and closer regional cooperation.

Through the implementation road map, a structured and effective organizational plan can be created to link the substantive work of the various annual meetings of States, supporting the idea of undertaking these discussions within specific sessions dedicated to the 2011 open-ended meeting of governmental experts and the 2012 Review Conference, respectively (which could be interlinked to discussions proposed under proposal number 1), and taking into account that the Biennial Meeting of States will consider the implementationof the programme of action and the Review Conference will review the progress made in its implementation and its structure.

One delegation expressed some concern with the proposal to “revitalise” the Executive Committee, noting that it was already carrying out important functions and should retain its advisory role to the Commission, but should not take decisions that were the responsibility of the Commission.

Registration should contain the identity of the detainee, the date, time and place of the detention, the identity of the authority that detained the person, the ground for the detention, the date and time of admission to the detention facility and the state of health of the detainee upon admission and any changes thereto, the time and place of interrogations, with the names of all interrogators present, as well as the date and time of release or transfer to another detention facility.
