Real signs of improvement had been seen in the conditions of indigenous peoples, victims of violence and past abuses, and the institutional promotion of human rights in the country.

Whereas it has been internationally recognized, including by the principal organs of the United Nations, that Armenia unleashed the war, attacked Azerbaijan and occupied its territories, including the Daghlyq Garabagh (Nagorno Karabakh) region, carried out ethnic cleansing on a massive scale, perpetrated other heinous crimes in the course of the war and established the ethnically constructed subordinate separatist entity on the captured Azerbaijani territory, it is curious that Armenian propaganda continues to qualify the aggression against Azerbaijan as “a peaceful and constitutional demand of the Nagorno Karabakh people to exercise its right to self-determination”.

Yemen recalled the recent Israeli attack against the Gaza strip and indicated that Israel has ignored recommendations since 1948 and so it is not surprising that it will ignore the largest number of UPR recommendations, specially those related to putting an end to the occupation in all occupied Palestinian and Arab territories and to recognizing the right of Palestinian people to self-determination, to an independent sovereign state with Jerusalem as a capital, and to the right of return of Palestinian refugees to their homeland and their right to compensation and restitution of their properties.

The meeting strongly welcomed the advances in results-based programming which should, nonetheless, be further strengthened and refined with a view to achieving a better balance between qualitative and quantitative indicators, complementarity with the expected outcomes of the Medium-Term Strategy and coherence between expected outcomes, expected results, as well as monitoring instruments and reporting standards.

The introductory report addressed a number of questions including: terminological issues; the general significance of subsequent agreements and practice in treaty interpretation; the question of inter-temporal law; the relationship between evolutionary interpretation and subsequent agreements and practice; the various elements of subsequent agreements and practice, including: the beginning and the end of the relevant period within which this phenomenon may take place, the identification of a common understanding or agreement by the parties, including the potential role of silence, questions of attribution of conduct to the State; as well as subsequent agreements and practice as a possible means of treaty modification.
