While the first complainant was doing his compulsory military service, his parents fled to Saudi Arabia.

In this context, MINUSTAH certainly has an important role to play, and there is still room to increase the number of troops and police officers serving within the Mission to reach the levels authorized by resolutions 1908 (2010) and 1927 (2010).

In the former Yugoslav Republic of Macedonia there is no provision which creates a service within the armed forces, although the Defence Law is in the process of being amended so that it will reflect the provisions of the Convention.

If it is to be assumed that the intention of the drafters was to declare compulsory military service a violation of the ―right to conscientious objection,‖ then one would legitimately challenge the rationale behind providing in another article for recognition of this ―violation‖ in some States as an exception to forced or compulsory labour.

It is, however, concerned that many young children still perform harmful work, such as domestic work with characteristicsof slavery, and hazardous work in garbage dumps, banana plantations and the mining industry, including forced labour, and that many of these children do not attend school.

Those measures, which had been taken up by the European Union, included an immediate halt to the production of fissile material for nuclear weapons; the dismantlement of nuclear installations and test sites, but also of decommissionednuclear warheads; a reduction of all nuclear arsenals, in the spirit of the new treaty between the United States and the Russian Federation; a limiting of the role of nuclear weapons in defence doctrines to extreme cases of self-defence; greater transparency as to the number of nuclear weapons held by each State, following the example of France and the United States; prompt ratification of the Test-Ban Treaty by all States, particularly annex II States, that were not yet parties to that instrument; and immediate negotiation of a fissile material cut-off treaty.

(b) except insofar as a State which is not Party to this Protocol may accept and apply its provisions in accordance with Article 3, paragraph 2, members of the armed forces and nationals of a State which is not Party to this Protocol, except for those nationals serving in the armed forces of a State which is a Party to this Protocol, do not incur individual criminal responsibility by virtue of this Protocol, nor does this Protocol impose an obligation to establish jurisdiction over such persons or to extradite them.
