The Conference’s rule of unanimity was not established by chance, and we are aware that this negotiating forum has proven useful for all of us in the past.

A member was of the view that the follow-up of recommendations dealing with issues that are also the subject of conventions adopted by UNESCO may still be considered relevant since not all States Members of UNESCO are parties to such conventions.

One Member reminded the Executive Committee that institutional strengthening was not one of the items on the list of eligible incremental costs and was therefore part of a special deal between Article 5 and non-Article 5 Parties and that the future of institutional strengthening would need to be re-examined in the context of the HCFC phase-out.

The Advisory Committee received the following clarification: in spite of the timing of its presentation, the proposal of the Secretary-General to establish an Emergency Preparedness and Support Unit was intended not to respond specifically to requirements related to the recent natural disaster in Haiti, but rather to put in place arrangements to deal with any crisis that has occurred or that may occur as the result of natural disasters, malicious acts directed at the United Nations or other emergencies.

The development of the list of experts is not intended to create any closed-ended expert group or other parallel or subsidiary bodies of the expert group.

Progress has also been made in addressing the needs of least developed countries regarding financial and technical assistance, trade capacity, market access and debt relief, though not all commitments and targets have been fully realized.

Several delegations expressed the wish for a reference to the fact that children’s special and dependent status may constitute an obstacle to the pursuit of domestic remedies, recognizing the fact that it would not always be the case.

Finally, it was agreed that the commentary should clarify: (a) that, if a security agreement had been concluded but its effectiveness was the subject of a dispute between the secured creditor and the grantor, the grantor could seek to amend or cancel the registration through a summary judicial or administrative proceeding; (b) that recommendation 32, which reiterated the principle reflected in recommendations 16 and 17, was not inconsistent with recommendation 67 (advance registration) of the Secured Transactions Guide; (c) whether the grantor could claim damages for breach of contract or tort by the secured creditor was a matter of other law; and (d) examples of proceedings referred to in recommendation 32.

Unlike patents, copyright protection does not require registration or other formalities (although this was not always the case).

Reiterating that the burden of proof was not placed on the accused in cases of torture, he said that, in accordance with the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol), judges were authorized to take any steps necessary to ascertain the facts in allegations of torture.

In response to questions from the floor, the representative of UNEP explained that the joint workshop for ozone officers and civil aviation officials would be funded through UNEP’s CAP and that the cooperation with Japan in the Climate Offset Mechanism was not a “costed” activity under the business plan.

But this is far from a simple matter of U.S. pressure – it is an emerging view that China’s interests are more like those of the other great powers than a G77 member.

As with the Standard Minimum Rules for the Treatment of Prisoners, in view of the great variety of legal, social, economic and geographical conditions worldwide, it is evident that not all of the following rules can be equally applied in all places and at all times.

The criminal justice system and legislators are not immune to such values and thus have not always regarded violence against women with the same seriousness as other types of violence.

Essentially, the strategic concept provides for the following: an increase in the level of United Nationssupported AMISOM uniformed personnel from 12,000 to 17,731, including 5,700 from the new troopcontributing countries, a Djiboutian contingent and the rehatted Kenyan troops, as well as an AMISOM police component; the deployment by Burundi and Uganda of additional troops to reach the current United Nationsauthorized strength of 12,000; the extension of AMISOM’s area of responsibility, including the insertion of AMISOM troops in the areas liberated with the support of Ethiopia; the provision of the required force enablers and multipliers, as well as logistical support to other components of AMISOM; and, last but not least, enhancement of the TFG security and allied forces, so as to enable and empower them to play an increased role in the implementation of the strategic concept.

Marking products with a patent number are commonly used but not obligatory.

These included the following observations: that since the Rules provide not only for arbitration but for negotiation and facilitated settlement as well, care should be taken not to render those aspects of the Rules inapplicable, particularly where the vast majority of cases are disposed of at the stages prior to arbitration; that to the extent the proposal purports to state a rule of substantive law its presence in a set of contractual rules may be problematic; that consideration could be given to re-casting the Rules as facilitated settlement rules rather than arbitration rules and thus avoiding the problem that the proposal is intended to address; and that the intended result might be achieved by using wording found in a note to Article 1 of the UNCITRAL Model Law on Electronic Commerce to the effect that its provisions are not intended to derogate from legal norms aimed at consumer protection.

The geographical indication prevents unauthorized parties from using a protected GI for products not from that region or from misleading the public as to the true origin of the product.
