The Office of the Prosecutor encourages law enforcement and judicial authorities in Bosnia and Herzegovina to take all necessary measures against those helping the remaining fugitives evade justice or otherwise obstructing the effective implementation of the Tribunal’s mandate.

The decision of the International Criminal Court will not justify any change in the obligation of the Government of the Sudan to comply with Security Council resolutions, to avoid impeding humanitarian assistance, as referred to in resolution 1828 (2008), and to ensure the safety and security of civilians and United Nations personnel.

In deciding a matter, an Information Commission has wide remedial powers, including to: order the public body to take such steps as may be necessary to secure compliance with the Law by providing access, in a particular form, by appointing information officers, by publishing certain information, by making changes to its record management systems, by enhancing the provision of training to its officials or by providing the Commission with an annual report; require the public body to compensate the complainant; or impose any other penalties provided for under the Law, for example to fine an information officer for obstructing access (sections 19(7)-(8)).

On the legal and drafting aspects, the Bills Committee notes its legal adviser's comment that since the obligation imposed on the MPFA to pay a special contribution under the proposed section 19B(1) does not appear to be mandatory, an aggrieved person may not have a cause of action against the MPFA if it has failed to pay the special contribution into that person's relevant account or has paid the sum to a wrong account.

In its Written Statement, in the same line of concern, Albania referred to the report published by the International Commission of Experts to indicate that “through a widespread and systematic campaign of terror and violence, the Kosovo Albanian population was to be forcibly displaced both within and without Kosovo”; the purpose of such a campaign would have been to “displace a number of [Kosovo Albanians] sufficient to tip the demographic balance more toward ethnic equality and in order to cow the Kosovo Albanians into submission” (para. 29).

Algeria was saddened that joining the block position of a group of countries, Portugal had not accepted the recommendation of Algeria and many other countries to adhere to a core human rights instrument, the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, although Portugal had long been a country of origin of migrant workers and was well placed to understand the suffering and indignity to which migrants were exposed.
