(3) Section 3 (to the extent that it relates to section 6D(2)(a) of the principal Ordinance as amended by this Ordinance), section 4 (to the extent that it relates to the repeal of section 7 of the principal Ordinance and to sections 7(1) and (4) to (11) inclusive and 7A of the principal Ordinance as amended by this Ordinance), section 5(a)(ii) and (b) and section 17(a), (ab) and (ac) shall come into operation on a day to be appointed by the Secretary for Information Technology and Broadcasting by notice in the Gazette.

He suggested that, for the sake of consistency, the expression “deemed to have been received” should be used at the end of paragraph 6 as well as in paragraph 5.

He therefore took it that the Committee wished to delete the words “, paragraph 2” at the end of article 9, paragraph 3, and thus refer to draft article 8 in its entirety.

The special report was requested pursuant to article 19, paragraph 1, in fine, of the Convention, which provides that States parties shall submit “such other reports as the Committee may request”.

(5) In order to highlight the fundamental function of objections, guideline 4.3, which begins the section of the Guide to Practice on the effect of an objection to a valid reservation, sets out the principle whereby an objection prevents the reservation from producing the effects intended by its author.655 This provides an initial clarification of the meaning of the phrase “the provisions to which the reservation relates do not apply as between the two States to the extent of the reservation”, which appears at the end of article 21, paragraph 3, of the Vienna Conventions and the meaning of which is clarified further in guideline 4.3.5.

She also suggested adding the phrase “regardless of frontiers” at the end of the first sentence, as per the wording of article 19, paragraph 2, of the Covenant.

The procedure envisaged by the draft (in paras. 3 and 4, to a large extent repetitive), should provide for: (a) the need to determine the arbitral tribunal’s fees and expenses as soon as practicable after its constitution (para. 4, at the end, assumes that “adjustments” to the arbitral tribunal’s determination of fees and expenses may intervene also when “the award has already been issued”), also in light of (b) below; (b) the right of an arbitrator to withdraw, should the third party’s (be it the appointing authority or the PCA) adjustments to the arbitral tribunal’s determination be held unacceptable.

(39) The expression “unless a contrary intention of the said State or organization can be identified”, which appears at the end of the first paragraph of guideline 4.5.2, reflects this positive presumption retained by the Commission subject to the intention of the reserving State or reserving international organization.

Colombia reported that the decree for regulating activities of NGOs and national standards was at an advanced stage of development.

His delegation therefore proposed the addition at the end of the second sentence of paragraph 2 of words to the following effect: “[... reasons for the challenge], and, as far as possible, provide the documents and other evidence relied upon by the challenger.

From a practical point of view, given that railway fares are set to the nearest of $0.1 and $0.5 for Octopus and single journey tickets respectively, it is not practicable to require MergeCo to adjust all individual fares by the same overall adjustment rate across the board.
