Whichever way the voting result goes, what is most important is that Members of this Council can work together to keep on urging and monitoring the Administration to the effect that it will propose and implement as soon as possible a sound retirement system for the protection of the people of Hong Kong.

Let me read out Article 14(d) of ICCPR, which says, " …… to be tried in his presence, and to defend himself in person or through legal assistance of his own choosing; to be informed, if he does not have legal assistance, of this right; and to have legal assistance assigned to him, in any case where the interests of justice so require, and without payment by him in any such case if he does not have sufficient means to pay for it;".

The Committee recommends that an investigation should only take place if there is a well-founded reason to believe that marriage or registered partnership has not been entered into willingly by both partners and recalls the importance of article 5 (d) (iv) of the Convention in this regard.

Our Government has in fact jumped the gun and violated ICCPR, taking advantage of the fact that we will not resort to the judge for every single matter, and neither will the judge deal with such matters for no reason at all.

I sincerely hope that though Members debated heatedly, they should put the interests of Hong Kong in the forefront and continue to do their best to urge China and the United Kingdom to reopen negotiation for an agreement.

Could the Administration therefore inform this Council whether a comprehensive review will be conducted with a view to revealing the real situation of triad infiltration in schools so that this Council will be in a better position to discuss the matter?
