Carers should have, within fostering agencies and other systems involved with children without parental care, the opportunity to make their voice heard and to influence policy.

Should family reintegration prove impossible within an appropriate period or be deemed contrary to the best interests of the child, stable and definitive solutions, such as adoption or kafala of Islamic law, should be envisaged; failing this, other long-term options should be considered, such as foster care or appropriate residential care, including group homes and other supervised living arrangements.

(a) Provide care for children in family-like settings, such as foster families or small group settings in residential care

The competent authority or agency should devise a system, and should train concerned staff accordingly, to assess and match the needs of the child with the abilities and resources of potential foster carers and to prepare all concerned for the placement.

States parties should, in cooperation with indigenous families and communities, collect data on the family situation of indigenous children, including children in foster care and adoption processes.

It is concerned that sometimes foster parents are selected as adoptive parents without necessarily going through the whole regular selection and eligibility process, potentially affecting the best interests of the child.

Such action may be taken at the request of the individual or their legal representative, and at the request of the foster family.

The latter institution is at the vanguard of Child Protection in the Federation being one of the government’s principal arms for ensuring that the rights of children are regarded, especially with respect to those in need of care and protection, those in conflict with the law, adoption and foster care and related issues.

Order No. 3088 of 29 November 2005 concerning the eligibility for financial support of an indigent person with a disability, arrangements for the deposit of funds with the foster family of such a person and the requirements a foster family must meet in order to be eligible to receive financial support for an indigent person with a disability.

UNICEF cooperation also contributed to improving the policy and legislative framework on child protection: the revised Law on the Protection of Minors, the 2007 National Plan of Action to Combat Trafficking in Women and Children, new provisions on children in the revised Law on the Protection of Persons with Disabilities, and national guidelines on community-based residential family care and foster care and on combating violence against children.
