Three years have passed since it was adopted, and the Committee should take steps to correct the notion that military courts may try civilians; its current position is completely out of step with modern standards of international human rights protection and with the most enlightened doctrine on the subject.

Such trends endanger the concept of “fair use”25 (and similar doctrines) as it applies now to printed works, and at the extreme may provide the equivalent of perpetual copyright protection, by technological rather than legal means.

Moreover, domestic demand could be supplied by parallel imports (governed in legal terms by what is known as the “exhaustion of rights” doctrine).63 They recognised that a special problem existed for countries with insufficient manufacturing capacity in making use of compulsory licensing, and instructed the TRIPS Council to find a solution by the end of this year.

Lastly, measures should be taken internationally to provide security assurances to non-nuclear-weapon States parties to the Treaty, such as universal commitment to the “no-first-use” principle, the gradual departure from reliance on nuclear weapons in military doctrines, and the relinquishing of the threat of use of nuclear weapons as a means to advance strategic interests.

The doctrine of separation of powers requires the legislature, executive, and judiciary to be kept separate from each other to provide checks and balances within the system and to ensure accountability and impartiality.
