Even when not enforced, such laws undermine the human dignity of lesbian, gay, bisexual or transgender people.

In addition, an association of lesbian, gay, bisexual and transgender persons had been registered.

With regard to the rights of gays, lesbians and transsexuals, and the legislation that recognized the rights of couples cohabiting and couples of the same sex, Uruguay reported on the new law on adoption guaranteeing this right for these couples and on the bill on gender identity.

It welcomed the role Uruguay had played in bringing attention to the rights of lesbian, gay, bisexual and transgender persons in international forums, and the measures taken nationally, including its leadership in being the first country in Latin America to provide for same-sex civil unions.

Canadian HIV/AIDS Legal Network congratulated the country for accepting recommendations dealing with programs to combat HIV/AIDS and promoting greater tolerance for the lesbian, gay, bi-sexual, and transgendered community.

With regard to recommendation 14 calling for the formulation and implementation of a national plan of action on the protection of civil rights of lesbians, gays, bisexuals and transgender persons, the delegation drew attention to the plan of action for the prevention of all forms of discrimination, racism, xenophobia, anti-Semitism and intolerance, which was a comprehensive document pertaining also to the rights of those persons.

Therefore, the current Government, although officially not in function, would continue its work on the implementation of the main policy measures to endorse full respect of human rights, inter alia: guaranteeing the equality of every citizen, promoting integration, fighting domestic violence by punishing perpetrators and protecting victims, combating the trafficking of human beings, protecting refugees and asylum seekers, promoting social acceptance of LGBT people in society and human rights education in the Dutch school.

The representative of Romania stated that withholding or obstructing in any way the consultative status of non-governmental organizations with valuable contributions to the Council and to society in general ran contrary to the general principle of anti-discrimination and diversity as enshrined not only in resolution 1996/31 and the decisions of the Council in 2006 and 2007 that recognized the importance of lesbian, gay, bisexual and transgender non-governmental organizations and their contribution to the work of the United Nations, but also to articles 2 and 26 of the International Covenant on Civil and Political Rights and ultimately to the Charter of the United Nations.

The Canadian HIV/AIDS Legal Network welcomed New Zealand’s articulation of the significant steps to treat lesbian, gay, bisexual and transgender people with equal dignity and respect and to provide equal recognition to same-sex partners.

Likewise, there was no evidence of any mob-related killing of lesbian, gay, bisexual or transgender persons.

Turning to the area of respect for diversity and combating stigma, Ms. Nunes pointed out that Brazil has a vast array of measures covering gender equality, lesbian, gay, bisexual and transgender (LGBT) people’s rights, elimination of racism, religious freedom, protection of human rights defenders, the rights of indigenous, Quilombola and Roma communities, access to justice, the dignity of persons deprived of liberty, the rights of migrants, and the protection of children, older persons and persons with disabilities.

The European Region of the International Lesbian and Gay Federation, in a joint statement with Federatie van Nederlandse Verenigingen tot Integratie Van Homoseksualiteit and COC Netherland, commended Portugal for accepting the recommendation to take further measures to provide police, prison and judicial staff with human rights training, with a focus on the protection of rights of women, children, ethnic or national minorities, and persons of minority sexual orientation or gender identity, and to strengthen the accountability of such personnel for their conduct, particularly when dealing with cases of hate crimes.

Along similar lines, the representative of Bulgaria stated that her delegation was disappointed with the outcome of the vote because it amounted to a discriminatory approach that had prevented the Committee throughout its history from recommending even a single lesbian, gay, bisexual and transgender organization for status.

In the Special Rapporteur’s view, this type of programme normalizes, stereotypes and promotes images that are discriminatory because they are based on heteronormativity; by denying the existence of the lesbian, gay, transsexual, transgender and bisexual population, they expose these groups to risky and discriminatory practices.

At its 37th meeting, on 27 July, the Council had before it draft decision IV, entitled “Associação Brasileira de Gays, Lésbicas e Transgêneros”, recommended by the Committee (see E/2009/32 (Part I) and Corr.1, chap.

This underrepresentation of women is even greater in the case of black, indigenous, young and lesbian women, women with disabilities, rural working women, domestic workers and women from low-income groups.

She also welcomed efforts to highlight abuses faced by lesbian, gay, bisexual and transgender persons around the world, an issue which would require sustained attention by the Council, as well as its resolution adopted by consensus on combating intolerance, negative stereotyping and stigmatization of, and discrimination, incitement to violence and violence against, persons based on religion or belief.

Also at the 37th meeting, following the rejection of draft decision IV, the representative of Brazil introduced a draft decision entitled “Application of the non governmental organization Associação Brasileira de Gays, Lésbicas e Transgêneros for consultative status with the Economic and Social Council” (E/2009/L.25).
