I have the honour to transmit to you, and through you to the members of the Security Council, clarification points regarding the referendum on the administrative status of Darfur, which will be conducted in accordance with the Darfur Peace Agreement signed in Abuja on 5 May 2006 and the Presidential Decree issued by the President of the Republic of the Sudan, Omar Hassan Al-Bashir, on 29 March 2011 in order to create a conducive atmosphere for the ongoing political process towards lasting peace and stability in Darfur (see annex).

With reference to the latest decisions of Pre-Trial Chamber I of the International Criminal Court of 27 August 2010 informing the Security Council about the visits of His Excellency Mr. Omer Hassan Al-Bashir, President of the Republic of the Sudan, to the Republic of Chad and Republic of Kenya, and the statements attributed to some members of the Security Council on the same subject, please find attached the press communiqué issued by the African Union condemning the latest move by the International Criminal Court (see annex).

The recent period (1999 to date) has seen a new phase of political and socioeconomic modernization under the presidency of Ismail Omar Guelleh.

The African Union Commission expresses its deep regret that both the statements and the decisions grossly ignore and make no reference whatsoever to the obligations of the two countries to the African Union arising from decisions Assembly/AU/Dec.245(XIII) adopted by the thirteenth ordinary session of the Assembly of Heads of State and Government, wherein the Assembly “Decide[d] that in view of the fact that the request by the African Union has never been acted upon (by the United Nations Security Council), the African Union Member States shall not cooperate pursuant to the provisions of article 98 of the Rome Statute of the International Criminal Court relating to immunities for the arrest and surrender of President Omer Al-Bashir of the Sudan”, which decision was reiterated (decision Assembly/AU/Dec.296(XV) at the fifteenth ordinary session of the Assembly in July 2010 in Kampala, Uganda.

I have the honour to transmit herewith resolution 7069 adopted by the extraordinary session of the Council of the League of Arab States, held at the ministerial level in Cairo on 4 March 2009, regarding the decision of Pre-Trial Chamber 1 of the International Criminal Court against the President of the Republic of the Sudan, Omer Hassan Ahmad Al-Bashir (see annex).

Before the action, the Council heard statements by video teleconference by the Prime Minister of Ethiopia and Chair of the Intergovernmental Authority for Development, Meles Zenawi; the President of Djibouti, Ismael Omar Guelleh; the Transitional Federal President of Somalia, Sheikh Sherif Ahmed; the Minister for Foreign Affairs of Kenya, Moses Wetangula; and the Permanent Representative of Uganda to the African Union.

After the international attention garnered by a coalition of environmental groups called Environnement Gabon demanding the publication of the contract between CEMEC and the Gabonese government in September 2007, President Omar Bongo reportedly invited two members of the NGO consortium to join the inter-ministry commission tasked with supervising the Belinga project.

It was agreed by both sides that the visit of His Excellency Mr. Salva Kiir, President of the Republic of South Sudan, to the Republic of the Sudan at the invitation of His Excellency President Omer Hassan Al-Bashir, would lay the foundations for permanently close relations between the two countries, in the best interests of their peoples.

On 3 July, the Prime Minister, Omar Abdirashid Ali Sharmarke, announced a newly reshuffled Cabinet of 39 members, including five members from Ahlu Sunnah Wal Jama’a (ASWJ) and new members from the Somali diaspora.

As we stated on 16 January, we would like to recognize the courage and leadership demonstrated by President Omer Al-Bashir and First Vice-President Salva Kiir Mayardit, as well their commitment to implementing a major milestone of the Comprehensive Peace Agreement.

In February 2009, the Special Adviser urged that any decision by the International Criminal Court regarding the request for indictment of President Omar al-Bashir should under no circumstances lead to reprisals that would expose civilians in Darfur or in any other part of the country to even greater levels of violence, including the risk of genocide.

The meeting reconvened in Kenana (White Nile State) the following day under the chairmanship of President Omar al-Bashir and established a 13-member presidential council and 7 subcommittees, chaired by eminent political and civil society actors.

After necessary consultations pursuant to that resolution, Mr. Kofi Annan, then Secretary-General, and Mr. Alpha Oumar Konaré, then Chairperson of the AU Commission, signed the Declaration entitled “Enhancing UN-AU Cooperation: Framework for the Ten-Year Capacity-Building Programme for the African Union” in November 2006 at the African Union headquarters in Addis Ababa, Ethiopia.
