International Court of Justice Judge Kenneth Keith describes the relationship between State responsibility and the responsibility of an official in the following terms: “[E]ven if States cannot commit international crimes, they might ... be held to be subject to the same obligations as individuals, without the obligations being characterized as criminal; that is to say, the obligation may be dual, binding both States and individuals”.

, the United States Federal District Court notes that “even if head-of-state immunity does apply to former heads of state, that immunity may be waived at any time either by Dr. Mitchell in his present capacity as the head of state of Grenada or by any subsequent administration that should come into power after Dr. Mitchell’s tenure has ended” (the case dealt with the filing of a civil suit against three defendants, including Keith Mitchell, the Prime Minister of Grenada, and his wife, Marietta Mitchell; the court recognized the immunity of these two individuals on the basis of the claim of immunity made by the United States Department of State and the absence of a waiver of immunity, but without prejudice to the possibility of refiling the suit).

Also at its first special meeting, the Committee elected, by acclamation, Bedrich Moldan (Czech Republic) and Keith Christie (Canada) as Vice-Chairs, to complete the unexpired terms of Jiri Hlavacek (Czech Republic) and John Matuszak (United States of America), respectively.

It was suggested that the States Parties reflect on how they can enable the necessary in-depth analysis and discussion of the requests in order to ensure that high quality requests continue to be the norm.

Five major themes of convergence between these three authors were identified during that first informal reflection process: (i) the place of pedagogy in their work, especially through education, experimentation and learning; (ii) nature, in the form of the desire for the search for a new covenant of solidarity between humanity and its environment; (iii) scientific and technological progress, enriched by dialogue with all forms of knowledge; (iv) human rights and democracy in response to colonialism, discrimination and political, economic, social and cultural exclusion; and, lastly (v) art and, in particular, poetry as a form of unique mediation between people and nature, and between individuals and their fellows.

During this session, the SHS and SC Commissions examined the resolution proposed in document 35 C/COM SC/DR.1 (submitted by: Austria, Belgium, Plurinational State of Bolivia, Burkina Faso, Congo, Democratic People’s Republic of Korea, Denmark, Djibouti, Dominican Republic, Finland, Iceland, Libya, Lithuania, Luxembourg, Madagascar, New Zealand, Netherlands, Norway, Palau, Papua New Guinea, Poland, Portugal, Samoa, Senegal, Slovenia, Sweden, Tuvalu, Uruguay; co-sponsored by: Barbados, Costa Rica, Germany, Kazakhstan, Latvia, Lebanon, Malaysia, Monaco, Pakistan, Solomon Islands, Suriname, and Zambia), requesting the Director-General to strengthen UNESCO’s specialized capacity on climate change, building upon UNESCO’s unique interdisciplinary profile.

(25) The debate also highlighted other themes which should be taken into account in the preparation of document 33 C/5: freedom of expression in the Internet age; safety of journalists; development of guidelines for access to information; policies on public domain information; the role of libraries and archives in building knowledge societies (also proposed as a theme for new intersectoral cooperation); continuation of the Memory of the World Programme as a flagship activity; reflection and guidelines on the use of open source software; capacity-building in communication and information and training of media professionals; public service broadcasting; development of community multimedia centres; and development of diverse and multilingual local content.
