The Inspector is also mandated with monitoring whether all issues related to detainees are conducted in a manner consistent with Constitution of the Maldives and applicable laws, the international conventions to which the Maldives is a State Party, Government’s policies, and according to regulations governing detention, and note areas that require revision, and report back to the Minister, as well as undertake necessary steps to correct issues that require attention.

We welcome the draft United Nations rules for the treatment of women prisoners and non-custodial measures for women offenders.86 Taking note of the outcome and the recommendations of the meeting of the expert group to develop supplementary rules specific to the treatment of women in detention and in custodial and non-custodial settings, we recommend that the Commission on Crime Prevention and Criminal Justice consider them as a matter of priority for appropriate action.

In the months ahead, we propose to commence the trials of the two remaining cases of detainees, file new requests for the referral of the cases of eight of the remaining 11 fugitives to Rwanda for trial by the end of August or early September, intensify our efforts in tracking and arresting fugitives, and prepare for the commencement, early in 2011, of evidencepreservation hearings in respect of three top-level fugitives.

In the same resolution, the Commission requested the Executive Director of UNODC to convene in 2009 an open-ended intergovernmental expert group meeting to develop, consistent with the Standard Minimum Rules for the Treatment of Prisoners and the United Nations Standard Minimum Rules for Non-custodial Measures (the Tokyo Rules), supplementary rules specific to the treatment of women in detention and in custodial and non-custodial settings; and welcomed the offer by the Government of Thailand to act as host to the expert group meeting.

In the Americas, the population-weighted detention rate in 2010 was significantly higher than in all other regions: it was 67 per cent higher than the detention rate in Europe, more than three times as high as the detention rate in Oceania and Africa, [...] [...]

Arbitrarily detained persons were deprived of most of their rights, a situation that amounted to a systematic denial of human dignity and that must therefore be qualified as inhuman and degrading treatment.

The Committee stressed that “States parties are under the obligation to respect the right to work by, inter alia, prohibiting forced or compulsory labour and refraining from denying or limiting equal access to decent work for all persons, especially disadvantaged and marginalized individuals and groups, including prisoners or detainees, members of minorities and migrant workers” (general comment No. 18, paras. 18 and 23).

The group’s existence and the government response show that despite enormous gains made in counter-terrorism efforts since the first Bali bombs in 2002, intelligence remains weak; monitoring of prisons and ex-prisoners remains a problem; police handling of “active shooters” needs improvement; and corruption continues to be a major lubricant for terrorist activities in Indonesia.

He must not demand freedom for political prisoners elsewhere while holding Puerto Ricans in jail.

Finally, in the Bangkok Declaration on Synergies and Responses: Strategic Alliances in Crime Prevention and Criminal Justice,i adopted by the Eleventh United Nations Congress on Crime Prevention and Criminal Justice on 25 April 2005, Member States declared that they were committed to the development and maintenance of fair and efficient criminal justice institutions, including the humane treatment of all those in pretrial and correctional facilities, in accordance with applicable international standards (para. 8); and they recommended that the Commission on Crime Prevention and Criminal Justice should give consideration to reviewing the adequacy of standards and norms in relation to prison management and prisoners (para. 30).

France, like the European Union, requests that consular access be granted immediately under the Vienna Convention to the nationals of member States who at this moment are being held in Israel after the operation.

(d) Children are not always held separately from adults and under acceptable conditions, and are detained in poor conditions when being held in police stations while under arrest or during pre-trial detention.

Many of these men, seized near the Pakistani border, or while crossing from Afghanistan to Pakistan, were held in prisons in Kohat and Peshawar, but others were held in what appear to be impromptu facilities, which were established across the country in numerous locations.

Her statement notes that two of her brothers travelled to New York gold camp, and that she followed them, spending the night in Prime Timber Production refugee camp with another woman whose husband was jailed in Zwedru as part of the Youbor convoy.

Having survived that massacre, he was once again held in complete isolation in an individual cell for several more years, still without any communication with the outside world or the other prisoners and without any family visits or contact with a lawyer.

Building upon article 37 (c) of the Convention on the Rights of the Child, general comment No. 10 of the Committee on the Rights of the Child reiterated the well-established rule that children must be detained separately from adults, adding that there is abundant evidence that the placement of children in adult prisons or jails compromises their basic safety, well-being and their future ability to remain free of crime and to reintegrate.

Those activities, together with the seizure of the Gaza Strip in which 1.5 million Palestinians were living in conditions that resembled a prison camp, the failure of Israel to reopen Palestinian institutions in East Jerusalem, and the 11,000 Palestinians still held in Israeli prisons, were not conducive to advancing the peace process and giving people hope and encouragement.

I demand that pressure should be brought to bear on Israel to free all Syrian prisoners and detainees held in the prisons of the occupation and withdraw from the occupied Syrian Golan, in conformity with the relevant international resolutions, including Security Council resolution 497 (1981).

In conclusion, it may be mentioned that the second additional provision to the Free Legal Aid Act grants the right to free legal aid, without any requirement of proof of insufficiency of resources to bring suit, to associations of public utility established to promote and defend the rights of persons with disabilities.

The resolution to be adopted by the Security Council on the cessation of aggression and war against Gaza must reiterate the need for the political process to continue under genuine and effective international supervision in order to ensure that an independent Palestinian State will be created within the 1967 borders and with Al-Quds Al-Sharif as its capital; that a just and agreed solution will be found to the issue of Palestinian refugees in accordance with General Assembly resolution 194 (III) of 1948; and that all detainees and prisoners will be released.
