When making a notification of succession establishing its status as a party or as a contracting State to a treaty, a newly independent State may, in the conditions laid down in the relevant guidelines of the Guide to Practice, object to reservations formulated by a contracting State or State party or by a contracting organization or international organization party to the treaty, even if the predecessor State made no such objection.

Nevertheless, in view of the lack of recent information, including from EI and ETA, the Joint Committee considered it necessary to suspend any further consideration of the allegations until such time as one or more of the parties provided relevant information on recent developments.

Unless the treaty otherwise provides or the negotiating States have otherwise agreed, the provisional application of a treaty or a part of a treaty with respect to a State shall be terminated if that State notifies the other States between which the treaty is being applied provisionally of its intention not to become a party to the treaty.

However, States Parties recognise that others may have the ability to assist in understanding challenges and in developing and monitoring the effectiveness and implementation of plans and programmes.

As can be seen, this guideline is based on the provisions of article 20, paragraph 4, of the Vienna Convention on the Law of Treaties, which sets out a general rule that: “(a) acceptance by another contracting State of a reservation constitutes the reserving State a party to the treaty in relation to that other State if or when the treaty is in force for those States; (b) an objection by another contracting State to a reservation does not preclude the entry into force of the treaty as between the objecting and reserving States unless a contrary intention is definitely expressed by the objecting State; (c) an act expressing a State’s consent to be bound by the treaty and containing a reservation is effective as soon as at least one of the contracting States has accepted the reservation”.

Noting with satisfaction that there are one hundred and sixty-three States parties to the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction,1 including all of the permanent members of the Security Council

When, under the terms of the treaty or by reason of the limited number of the negotiating States and the object and purpose of the treaty, the participation of any other State in the treaty must be considered as requiring the consent of all the parties or of all the contracting States, the newly independent State may establish its status as a party or as a contracting State to the treaty only with such consent.

(b) If the States parties to the dispute fail to reach agreement within three months on all or part of the composition of the Commission, the members of the Commission not agreed upon by the States parties to [...] [...]

When a successor State formed from a uniting or separation of States makes a notification whereby it establishes its status as a party or as a contracting State to a treaty which, at the date of the succession of States, was not in force for the predecessor State but to which the predecessor State was a contracting State, that State shall be considered as maintaining any reservation to the treaty which was applicable at the date of the succession of States in respect of the territory to which the succession of States relates, unless it expresses a contrary intention when making the notification or formulates a reservation which relates to the same subject matter as that reservation.

The usual double standards and the threat by one permanent member to veto any draft resolution aimed at a just and impartial solution had shackled Security Council attempts seriously to address the issue.

Part II also includes in the country reviews the responses from Article 5 countries to Decisions 43/3/(c)(i) and 43/4(d) on the submission of projects remaining in the 2004 business plans for countries at risk of non-compliance and the impediments to achieving compliance.
