The Subcommittee recommends that the State party consider the possibility of increasing police salaries, so that they can support themselves in a dignified manner, without resorting to practices that constitute a clear abuse of authority and entail a risk of cruel, inhuman ordegrading treatment.

These include proposals for the establishment of (a) 13 Safety and Security posts under section 35, comprised of 5 General Service (Other level) posts in Geneva to implement a necessary canine unit and lead crisis management training, and 8 General Service (Local level) posts in Addis Ababa to support the security control centres, (b) 4 General Service (Other level) posts under section 24 to provide administrative and clerical support to the Human Rights Council and the treaty bodies, including the Committee on Enforced Disappearances and the Subcommittee on Prevention of Torture and Other Cruel, Inhuman or Degrading Treatment, (c) 2 General Service (Other level) posts to support the International Court of Justice and (d) 2 General Service (Local level) posts in UNTSO to provide transportation services across international borders.

These included: arbitrary detention; torture or cruel, inhuman or degrading treatment or punishment; summary and extrajudicial executions; sexual violence, including rape, sexual abuse and sexual exploitation; and other forms of violence grounded in discrimination against women.

(b) To take persistent, determined and effective measures to have all allegations of torture or other cruel, inhuman or degradingtreatment or punishment investigated promptly, effectively and impartially by an independent, competent domestic authority, as well as whenever there is reasonable ground to believe that such an act has been committed; to hold persons who encourage, order, tolerate or perpetrate such acts responsible, to have them brought to justice and punished in a manner commensurate with the gravity of the offence, including the officials in charge of the place of detention where the prohibited act is found to have been committed; and to take note, in this respect, of the Principles on the Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the updated set of principles for the protection of human rights through action to combat impunity as a useful tool in efforts to prevent and combat torture

Otherwise, perspiration or moisture may enter the gaps between the protective stickers and the parts, which may result in a skin rash and/or corrosion of the metal parts.

The European Union believed that a more determined effort must be made to fight poverty and HIV/AIDS, which were synonymous with denial of rights; the economic, social and cultural rights must be more vigorously promoted through legislation; torture and other cruel, inhuman or degrading treatment or punishment had to be firmly condemned; and all human rights defenders, whom it hailed for working in the face of considerable risk, should be strongly supported.

(a) The specific measures taken to fight impunity for violations of human rights, including disappearances and torture and other cruel, inhuman or degrading treatment or punishment committed by public officials as well as private actors acting with the acquiescence or consent of government officials.

The Attorney for Human Rights noted, inter alia, that the jail had 50 places, but that at the time of the first inspection there were 104 inmates and at the time of the second, 109; the budget allocation for food was 8.30 lempiras a day per inmate; some cells were prone to flooding from water leaks, yet because there were not enough beds many inmates slept on the wet floor; the toilets were constantly foulsmelling and full of filth becausethere were not enough for the large number of inmates, which constitutes a hazard to their health; overcrowding is a serious risk to the individual and collective safety of the prisoners, with men and women, members of rival gangs, prisoners with mental illnesses, and convicted prisoners and prisoners awaiting trial sharing the same cells; and the lack of security and the absence of authority had led to a violent incident on 27 October 2005, in which an inmate lost his life.

There are many opportunities for reducing the energy consumption of transport refrigeration systems, including improved insulation to reduce cooling losses and load, compressor frequency control for partial load conditions, water-cooled condensers for shipboard systems and preventive maintenance to reduce heat exchanger fouling.

All States countering terrorism must comply with their obligations under international law, in particular by ensuring respect for the absolute prohibition of torture and other cruel, inhuman or degrading treatment or punishment; ensuring that all persons deprived of liberty benefit from the guarantees to which they are entitled under international law, including the review of the detention and other fundamental judicial guarantees; ensuring that no form of deprivation of liberty places a detained person outside the protection of the law; respecting due process obligations and the right to a fair trial; abiding fully by non-refoulement obligations; ensuring legality in the criminalization of acts of terrorism; and respecting the right to an effective remedy.

Among the main international instruments recently ratified by Spain are the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (2005), the Convention on the Rights of Persons with Disabilities and its Optional Protocol (2007) and, more recently, the International Convention for the Protection of All Persons from Enforced Disappearance (2009).

Equally relevant are the Convention on the Elimination of All Forms of Discrimination against Women, article 12, concerning the obligation of States to eliminate discrimination against women in health care; the Convention on the Rights of Persons with Disabilities, article 25 (b), which requires that health services be “designed to minimize and prevent further disabilities, including among children and older persons”; and the International Covenant on Civil and Political Rights, article 7, which prohibits torture or cruel, inhuman or degrading treatment or punishment and includes the prohibition of medical or scientific experimentation without free consent.

Other relevant standards and norms are the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Assembly resolution 3452 (XXX), annex); the procedures for the effective implementation of the Standard Minimum Rules for the Treatment of Prisoners (Council resolution 1984/47, annex); the Tokyo Rules; the Kampala Declaration on Prison Conditions in Africa (Council resolution 1997/36, annex); the Kadoma Declaration on Community Service (Council resolution 1998/23, annex I) and related recommendations on prison overcrowding (Council resolution 1998/23, annex II); the Arusha Declaration on Good Prison Practice (Council resolution 1999/27, annex); and the basic principles on the use of restorative justice programmes in criminal matters (Council resolution 2002/12, annex).

24.80 The net increase of $787,900 relates to the following: (a) the delayed impact of one P-3 post approved as from 2011 to provide support to the Committee on the Rights of Persons with Disabilities; (b) the proposed establishment of five new posts as follows: (i) the P-4 post to assist the Committee on Enforced Disappearances in liaising with petitioners and States parties concerned, draft decisions and views under the individual communications procedure and followup on the implementation of the Committee’s views; (ii) one new P-3 post to assist the Committee on Enforced Disappearances with the examination of States reports presented under article 29 of the Convention; (iii) one new P-3 post to support the Subcommittee on the Prevention of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment in its new composition of 25 members (increase from 10 to 25 members), in view of the expected increase in workload of the Subcommittee.

Underlining the adoption by UNESCO of the Universal Declaration on Cultural Diversity in 2001 and of the Convention on the Protection and Promotion of the Diversity of Cultural Expressions in 2005, he stated that tolerance entailedrespect.

Two of the 4 general temporary assistance positions, 1 P-4 and 1 P-3 Training Officers, and 1 P-4 continuing post, currently funded from the support account, design, deliver, upgrade, harmonize and evaluate three ongoing cross-cutting leadership programmes: the senior mission leaders’ programme, a two-week course, conducted twice annually at a host Member State, for 26 candidates from Member States, the Secretariat, the United Nations agencies, programmes and funds); the senior leaders’ programme, a compulsory orientation course for all mission personnel at the D-2 level and above, conducted twice annually in New York; and SMART, an intensive year-long programme involving distance learning and three week-long workshops for two groups of 40 candidates.
