When the fair value of unlisted equity securities cannot be reliably measured because (a) the variability in the range of reasonable fair value estimates is significant for that investment or (b) the probabilities of the various estimates within the range cannot be reasonably assessed and used in estimating fair value, such securities are stated at cost less any impairment losses.

(b) To take persistent, determined and effective measures to have all allegations of torture or other cruel, inhuman or degrading treatment or punishment investigated promptly, effectively and impartially by an independent, competent domestic authority, as well as whenever there is reasonable ground to believe that such an act has been committed; to hold persons who encourage, order, tolerate or perpetrate such acts responsible, to have them brought to justice and punished in a manner commensurate with the gravity of the offence, including the officials in charge of the place of detention where the prohibited act is found to have been committed; and to take note, in this respect, of the Principles on the Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the updated set of principles for the protection of human rights through action to combat impunity as a useful tool in efforts to prevent and combat torture

Members note that each of the LLP legislation in the provinces of Alberta, Ontario, British Columbia and Manitoba of Canada and the State of Texas of US has a stipulation that removes LLP protection for a partner who has actual knowledge of the default but failed to exercise reasonable diligence to remove it, whereas each of the LLP legislation of the province of Ontario of Canada and the State of Texas of US also has a stipulation to remove LLP protection for a partner who ought reasonably to have known of the default but failed to exercise reasonable diligence to prevent it.

He emphasized that regional economic integration must be based on sound economic principles and agreed political commitments.

The Advisory Committee also emphasizes the importance of ensuring that Member States receive full assurance from oversight bodies as to the soundness of the management practices and internal controls of the project so as to provide reasonable confidence that the resources appropriated are protected and that institutional objectives are met.

Ms. Ghanea drew five preliminary conclusions: (a) the discussion on limitations to freedom of expression could not be dissociated from the overall obligations under the Covenant as a whole, such as full equality before the law, due process and rights of minorities; (b) random or orchestrated acts of violence that have no reasonable link to expression should not justify limitations to freedom of expression; (c) where hatred itself incited to violence, it showed a broader pattern of violations; triggering article 20 demonstrated a failure of the State to guarantee the right to non-discrimination under article 26; (d) article 20 also required a careful and calibrated range of sanctions; at a minimum, it should not infringe expression itself and at a maximum it could trigger sanction; care had to be taken for the limitations not to have a chilling effect on freedom of expression in general; and (e) other actions in the national sphere were needed.

The Committee reiterates its previous recommendation (CAT/C/FRA/CO/3, para. 20) whereby compliance with the provisions of article 12 of the Convention requires a derogation from the system of discretionary prosecution, so as to oblige the competent authorities to launch impartial inquiries systematically and on their own initiative wherever there are reasonable grounds for believing that an act of torture has been committed in any territory under its jurisdiction, in order to effectively ensure that the perpetrators of such crimes do not remain unpunished.

That, as most employees currently do not have rest breaks — some even have no meal breaks, during their working hours, and it has become increasingly prevalent for employers to require their employees to work on rest days, which harms employees' mental and physical health, increases the occurrence of accidents and the contracting of occupational diseases, and also reduces work efficiency, this Council urges the Government to stipulate by legislation that employers should provide their employees with reasonable rest and meal breaks during working hours, as well as to review the existing labour laws with a view to ensuring that employees enjoy the right to have rest days.

Persons whose rights have been violated by discriminating may also request payment of a reasonable amount of money as compensation for nonproprietary damage caused to them.

The Ministers in order to promote the human rights of women expressed their resolve to take appropriate measures at the national, regional and international levels to improve the quality of life and achieve gender equality and empowerment of women, bearing in mind the inherent potential of women, through inter alia adopting proper socio- economic strategies and programmes and provisions of government services to all women particularly women with disabilities and women in rural areas, including access to health, education and justice services and strengthening family well-being.

It is more reasonable to expect that relatively minor amounts of zooplankton meal may be used as a bioactive ingredient, or attractant, in aquafeed or in feed for fish larvae.

The directors believe that the estimated fair values resulting from the valuation technique, which are recorded in the consolidated balance sheet, and the related changes in fair values, which are recorded in the consolidated equity, are reasonable, and that they are the most appropriate values at the balance sheet date.

It is essential to seriously work towards creating favourable market access conditions for all products originating in least developed countries, including through the reduction or elimination of arbitrary or unjustified non-tariff barriers and other trade-distorting measures.

He submits that it is thus valid to challenge the legality of the decision to extradite him to Mexico before the Committee, the sole body dealing with the matter, and argues that clearly, a suit for damages filed subsequent to the torture he endured after extradition to Mexico cannot constitute an effective remedy that would have prevented his extradition and thus cannot be considered as an available means of domestic remedy.

The three fundamental goals of the PRS are: dynamic development and economic growth, focusing on job creation in the private sector; prevention of new poverty as a consequence of the forthcoming modernization and restructuring and the rationalization of State and its fundamental functions; efficient implementation of existing programmes and creation of new programmes, measures and activities directly targeting the poorest and socially most vulnerable groups, with a focus on the underdeveloped regions (children, the elderly, persons with disabilities, refugees and internally displaced persons, the Roma, the rural population and the undereducated), particularly in the least developed regions.

Regarding funding support for the arts groups, members in generally considered that the Administration should (a) ensure a reasonable and fair distribution of funding resources amongst arts groups; (b) review the existing mode of subsidy for the major performing arts groups to avoid stifling the development of non-subvented commercial arts groups; (c) provide more funding for the support of small and medium sized arts groups and budding artists; (d) explore means to minimize staffing and administrative expenses in the operation of arts programmes so that the savings could be re-allocated to the use of arts development; (e) examine the effectiveness of the current funding policy in achieving the policy goals, such as encouraging diversified and balanced development of arts and culture; and (f) consider increasing its overall allocation of funding for culture and the arts, given the imminent need to achieve the vision of the West Kowloon Culture District project.

The meeting strongly welcomed the advances in results-based programming which should, nonetheless, be further strengthened and refined with a view to achieving a better balance between qualitative and quantitative indicators, complementarity with the expected outcomes of the Medium-Term Strategy and coherence between expected outcomes, expected results, as well as monitoring instruments and reporting standards.
