It highlighted the research demonstrating that homophobic attitudes prevailed, and that lesbians, gays, bisexual and transsexuals were not only marginalized but treated as outcasts.

Turning to the area of respect for diversity and combating stigma, Ms. Nunes pointed out that Brazil has a vast array of measures covering gender equality, lesbian, gay, bisexual and transgender (LGBT) people’s rights, elimination of racism, religious freedom, protection of human rights defenders, the rights of indigenous, Quilombola and Roma communities, access to justice, the dignity of persons deprived of liberty, the rights of migrants, and the protection of children, older persons and persons with disabilities.

Its main courses of action are as follows: (a) to campaign for the human rights of gay men, lesbians, bisexuals and transgendered persons at the local, national and international levels; (b) to influence political decision-making at the local, national and international levels; (c) to provide information through magazines, newsletters, web-based services and leaflets; (d) to provide counselling services; and (e) to implement projects.

The delegation assured its commitment to work closely with the LGBTI community and NGOs to address the protection of this minority.

The United States is committed to continuing to promote the human rights of persons regardless of their sexual orientation or gender identity and is pleased to support the recent efforts of the independent and autonomous Inter-American Commission on Human Rights to place greater regional focus on this area, as well as the first United Nations resolution on the human rights of lesbian, gay, bisexual or transgendered individuals adopted by the Human Rights Council (resolution 17/19 on human rights, sexual orientation and gender identity).

However, given that about 97 per cent of transmission occurs through sexual contact, we are still dealing with the challenges of ensuring that people can exercise their rights, improving access to the information needed for making decisions and strengthening efforts to promote responsible sexual behaviour and prevention among exposed populations such as sex workers, men who have sex with men, transsexuals and prisoners, as well as among vulnerable groups of adolescents living in poverty.

Ms. Nunes highlighted the recognition of same-sex stable unions as family units by the Supreme Federal Court and the National Plan for Promotion of LGBT Citizenship and Human Rights.

Since 2008, Ecuador, in keeping with the Constitution, which states that all persons are equal and have equal rights, duties and opportunities, has taken steps to end the violation of the rights of the gay, lesbian, bisexual, transsexual, transgender and transvestite community.

Thus, last year the Government of El Salvador enacted a decree guaranteeing access to health-care services and respect for the human rights of men having sex with men, transsexuals, transgender people and lesbians.

To strengthen measures to prohibit discrimination based on sexual orientation and gender identity and combat hate crimes on these grounds (Netherlands); to undertake further campaigns against homophobia (Norway); to ensure adequate protection of LGBT people, not only through police forces on the streets, but legally via anti-discrimination law (Norway); to give special attention to cases of possible discrimination for reason of sexual identity or orientation, and ensure that cases of violence against such persons are appropriately investigated and prosecuted (Spain)

Understand the multiple layers of marginalization and representation by specifically focusing on the diversity of young people, including young women and girls; young people living with HIV/AIDS; young migrant workers; young people who are lesbian/gay/bisexual/transgender/intersexed/ questioning; young sex workers; young people who use drugs; and other young people who are denied their sexual and reproductive rights.

Targeting of specific groups was mentioned in relation to women human rights defenders in Bahrain, Serbia and Zambia; indigenous groups particularly in South American States such as Ecuador and Peru, and Asian States such as India and the Philippines; rural groups in Serbia; lesbian, gay, bisexual, transgender and intersex groups in Eastern European States such as Poland and Serbia, and South American States such as Argentina and Ecuador; witnesses in Peru; and persons belonging to minorities in Israel.

It also noted that were no laws explicitly prohibiting discrimination against lesbian, gay, bisexual and transsexual persons in employment, housing and access to education or health.

Regarding discrimination on the grounds of sexual and gender identity (recommendation 7), Ecuador implemented measures to combat violations of human rights in respect of the gay, lesbian, bisexual, transsexual, transgender and transvestite community.

In 2010 the States of Jersey introduced the Gender Recognition (Jersey) Law which makes provision for the legal recognition in Jersey of changes in gender by transsexual people so that they may enjoy any rights conferred by law on people of their acquired gender.

Finally, I am also deeply concerned by the absence of a target for the key populations that are also most vulnerable to HIV, such as transgender people, as well as by the disappearance of providing housing as a priority intervention.

While referring to the recommendations put forward to and approved by Finland in the UPR review regarding equal protection of persons based on sexual orientation and gender identity, JS2 stated that Finland failed to a high extent to adopt comprehensive strategies on protecting the human rights of lesbian, gay, bisexual, transgender and intersex people (LGBTI), contrary to those recommendations and that specific actions taken to this end had been limited.24 AI stated that transgender and intersex people faced discrimination by the authorities and by members of the public.

The Meeting noted the unique characteristic of the epidemic in the Asia-Pacific region: new infections were concentrated among key populations at higher risk, including men who have sex with men, people who use drugs, people who buy and sell sex, transgender persons, mobile populations and their intimate sexual partners.

The fifth conclusion and perhaps the essential issue here is the urgent need to eliminate stigmatization and the lack of involvement of key populations, including sex workers, drug users, prisoners, men who have sex with men and transsexuals.

The opening session also featured personal testimonies by representatives of the following key affected populations: transgender people, gay and bisexual men, sex workers, people who inject drugs, women and mothers living with HIV, migrants and other mobile population groups, as well as young people at higher risk of HIV.

The Government had also promoted policies and programmes to prevent and combat discrimination against persons with disabilities, persons suffering with HIV/AIDS, and lesbian, gay, bisexual and transgendered people.
