Taking into account the arguments of the State party to justify the degree of force used during the arrest operation and given the contradictory information contained in the file as to the existence of witness testimonies on the facts alleged under this claim, the Committee concludes that the author failed to substantiate this claim, for purposes of admissibility, and declares it inadmissible under article 2 of the Optional Protocol.

4.3 The State party further notes that the content of Mr. Usaev’s criminal case file does not confirm the author’s allegations that he did not sufficiently master the Russian language at the trial stage and should have been offered the services of an interpreter.
