In jurisdictions such as in South Africa, social and economic rights are explicitly enumerated as justiciable rights, courts are interpreting the obligations emanating from these rights, appropriately, through an equality lens.52 In order to establish a foundation of justiciability and effective review of such rights, and to ground an understanding of where governments must begin in the process of implementing them, in the face of massive problems and scarce resources, social and economic rights have been approached by advocates and courts within an ‘equality’ paradigm.
