The illegitimate occupation by the United Kingdom of Great Britain and Northern Ireland led to the adoption by the General Assembly of resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, in which it recognizes the existence of a sovereignty dispute regarding the “Question of the Falkland Islands (Malvinas)” and urges the Governments of Argentina and the United Kingdom of Great Britain and Northern Island to resume negotiations in order to find as soon as possible a peaceful and lasting solution to the dispute.

At the 39th meeting, on 28 July, the representative of Saint Kitts and Nevis, on behalf of Algeria, Antigua and Barbuda, China, Cuba, Dominica, Fiji, the Gambia, Grenada, Guyana, Jamaica, Nicaragua, Papua New Guinea, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Samoa, Sierra Leone, Solomon Islands, Suriname, the Syrian Arab Republic and Venezuela (Bolivarian Republic of), introduced a draft resolution entitled “Support to Non-Self-Governing Territories by the specialized agencies and international institutions associated with the United Nations” (E/2009/L.26).

In the following years, several other agreements have been signed: the Group of Three (G-3) between Colombia, Mexico and Venezuela (1989), MERCOSUR between Argentina, Brazil, Uruguay and Paraguay (1991), the transformation of the Andean Group into the Andean Community (1997), and the transformation of CARICOM (2002) into the Caribbean Community, including the CARICOM single market economy.

First, the Argentine Republic finds it necessary to remind the United Kingdom that there is a sovereignty dispute between the Argentine Republic and the United Kingdom over the Malvinas, South Georgia and South Sandwich Islands and the surrounding maritime areas and that the existence and characteristics of the dispute have been recognized by the United Nations in General Assembly resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25, as well as the resolutions adopted each year by the Special Committee on decolonization, whereby both Governments are urged to resume negotiations in order to find as soon as possible a peaceful solution to the dispute.

The United Nations General Assembly, in its resolution 2065 (XX) and in subsequent resolutions, and the Special Committee on Decolonization, have described the question of the Malvinas Islands as a special and particular colonial situation involving a sovereignty dispute between Argentina and the United Kingdom of Great Britain and Northern Ireland, have established that the way to put an end to that situation is the peaceful and negotiated solution of the sovereignty dispute, and have requested both Governments to continue without delay the bilateral negotiations recommended by the General Assembly and the Special Committee.
