Large corporations enjoyed a culture of impunity and the colonial Government had recently made thousands of public employees redundant by terminating many collective agreements.

The Organization’s exposure to the risks of industrial dispute or vendor bankruptcy would also be minimized.

The draft Labour Code, which is being discussed in the National Parliament, is the legal framework for labour or contractual relations and sets out the different labour guarantees, such as the maximum number of working hours, the different types of holidays, the right to take part in collective bargaining processes and the resolution of labour disputes.

The State party should lift the restrictions on “pattern barging”, the pursuit of multi-employer agreements and matters that are not “permitted”, and to remove the secret ballot requirements for workers who wish to take industrial action.

Decisions of the Employment Relations Authority can be appealed to the Employment Court.

She served as a judge of the Industrial Court of Botswana, a Superior Court of Law and Equity that specializes in labour law, from 1997 to 2009 (including as acting judge in 1997 and 1998 and thereafter as a permanent judge).

ILO works with the EU, EBRD, ASEAN and the ADB on international labour standards, wages and inequalities, social security, industrial relations, working conditions, labour administration and labour inspection, migration, skills needs forecasting, the green economy and green jobs.

As for Point I-5-r (Freedom of association and collective bargaining- conflict with local law), there is not such a case in Japan, but some overseas countries have huge industrial unions enjoying considerable influence.

Linde will always work in good faith, within the appropriate legal framework, with trade unions, works councils and any other bodies chosen collectively by employees to represent them.
