The StrugarTrial Chamber held that the elements of this crime are satisfied if: (1) the damage or destruction has been committed to institutions which may clearly be identified or regarded as dedicated to religion; (2) the property was not used for military purposes at the time of the acts and must not have been in the immediate vicinity of military objectives; and (3) the perpetrator acted with the intent to destroy the property.

4.8 The State party asks the Committee to note how similar the facts and situations described by the authors are and to take into account the socio-political and security context at the time; to note that the authors failed to exhaust all domestic remedies; to note that the authorities of the State party have established a comprehensive domestic mechanism for processing and settling the cases referred to in these communications through measures aimed at achieving peace and national reconciliation that are consistent with the principles of the Charter of the United Nations and subsequent covenants and conventions; to find the above-mentioned communications inadmissible; and to request the authors to avail themselves of the appropriate remedy.

ILO Convention No. 29 also provides that the term “forced or compulsory labour” shall not include any work or service exacted from any person as a consequence of a conviction in a courtof law, provided that the said work or service is carried out under the supervision and control of a public authority and that the said person is not hired to or placed at the disposal of private individuals, companies or associations (Art 2 (c)).

Furthermore, the State party should take vigorous steps to eliminate impunity for alleged perpetrators of acts of torture and illtreatment, carry out prompt, impartial and exhaustive investigations, try the perpetrators of such acts and, where they are convicted, impose appropriate sentences, and properly compensate the victims.

(a) To what extent does the national legislation of Member States include provisions on criminalizing violence against migrants, migrant workers and their families?
