It was also suggested that FAO should undertake technical work in the following five priority areas to assist States and RFMOs implement resolutions 61/105 and 64/72 and the FAO Guidelines: (i) improving and expanding application of the criteria for the identification of VMEs beyond corals, sponges, seamounts and hydrothermal vents; (ii) developing guidance on impact mitigation measures and best practices for developing and applying encounter protocols relevant to VMEs, particularly by RFMOs; (iii) developing guidance on what and how information should be collected to implement measures for managing fishery impacts on VMEs; (iv) defining certain terms that could clarify implementation of the FAO Guidelines; and (v) developing guidance on best practices for conducting assessments.

The Director-General has also borne in mind that the present C/4 and C/5 system is rather complex and cumbersome, that it has too many layers with too many categories difficult to distinguish (e.g. cross-cutting themes, mainstreaming, flagships, principal and other priorities), that it limits flexibility to meet evolving programme resource needs, that intersectoral efforts are too often an afterthought in the programming exercise and that monitoring does not receive sufficient attention.

VIII.13 In its previous reports on progress made in the implementation of the enterprise resource planning system (A/65/576, A/64/7/Add.9 and A/63/487), the Advisory Committee made observations and expressed some concerns on a number of issues, including the delays in staffing the project team; the lengthy process of recruiting subject-matter experts; the need for closer cooperation between the project team and the Office of Information and Communications Technology in cataloguing and decommissioning the systems to be replaced by the enterprise resource planning system; the need for closer cooperation between the project team and the Office of Information and Communications Technology and the Department of Field Support in implementing technical activities and infrastructure; and the complexity and number of the interfaces to be developed between the enterprise resource planning system and the human resources management system, Inspira.

I have encountered really poor and destitute people in my life and in my ministry as a religious leader, and I would like to ask the international community, especially the developed countries, not to underestimate the resourcefulness of the poor and not to find them burdensome.

While there is no need to repeat any of these here, since they have been submitted separately to the Executive Committee under the annual work programmes for each of the sector plans, it is useful to briefly introduce the work that has been carried out in the control of imports and exports of ODS under the project.

It was also agreed that the commentary should be expanded to include additional examples of situations in which exclusions might be appropriate, including where there were burdensome assets, such as assets carrying an environmental liability or assets that would be difficult or costly to administer, or where the consequences of fraud might be exacerbated if certain assets were to be included in the order for substantive consolidation.

After discussion, the Working Group agreed that the questions for further consideration on that matter would include (A/CN.9/717, para. 143): (i) whether a provision on protection of the integrity of the arbitral process should be in the form of a general formulation or should contain specific instances that were meant to be specifically addressed; (ii) the interplay between the protection of the integrity of the arbitral process and the provisions in the UNCITRAL Arbitration Rules already dealing with that issue; and (iii) how to determine the threshold for a limitation to transparency based on the ground of the need to protect integrity of the arbitral process.

A few participants, however pointed to a danger that the term “quality education” tended to become too broad complicating any assessment of outcomes or measurement of results, and that an agreed-to definition was warranted.

A large number of speakers suggested that the C/5 document was too voluminous and not entirely user-friendly, noting however that progress had been made towards its simplification and increased clarity.
