In respect of all periods other than the Relevant Period, a Director may vote in respect of any contract, arrangement or transaction or proposed contract, arrangement or transaction notwithstanding that he or any of his associates is or may be interested therein and, if he does so, his vote shall be counted and he may be counted in the quorum at any meeting of the Directors at which any such contract, arrangement or transaction or proposed contract, arrangement or transaction shall come before the meeting for consideration provided that he has, where relevant, first disclosed his interest in accordance with paragraph (G).

The mandate of the Commission is to decide through binding arbitration all claims for loss, damage or injury by one Government against the other, and by nationals (including both natural and juridical persons) of one party against the Government of the other party or entities owned or controlled by the other party that are (a) related to the conflict that was the subject of the Framework Agreement, the Modalities for its Implementation and the Cessation of Hostilities Agreement, and (b) result from violations of international humanitarian law, including the 1949 Geneva Conventions, or other violations of international law.

This generally implies that no information or personal data may be made available or published, particularly in the media, that could reveal or indirectly enable the disclosure of the child’s identity, including images of the child, detailed descriptions of the child or the child’s family, names or addresses of the child’s family members and audio and video records.

In this regard, I wish to draw your attention to the following illegal actions perpetrated by Israel, the occupying Power, in the Occupied Palestinian Territory, including East Jerusalem, and to reiterate the appeal of the Palestinian people and their leadership to the international community, including the Security Council, to uphold its legal obligations and responsibilities and to act forthwith to bring an end to this unlawful and dangerous situation and to salvage the prospects of realizing a just, comprehensive and lasting peace settlement by which, inter alia, the Palestinian people will realize their right to self-determination and freedom in their independent, sovereign, democratic, contiguous and viable State of Palestine, with East Jerusalem as its capital, on the basis of the pre-1967 borders.

The report on Israeli settlements in the Occupied Palestinian Territory, including East Jerusalem, and the occupied Syrian Golan (A/66/364), based on information provided by United Nations bodies operating in the territory and by Israeli and Palestinian non-governmental organizations, recommended, inter alia, that Israel should comply with its international legal obligations and its Road Map commitments in respect of settlements and that all serious allegations concerning settlement-related criminal acts should be properly investigated and prosecuted.

Legislation makes provision for the following aspects of free government assistance for the victims of trafficking in persons: supply of temporary accommodation, including board and lodging; legal assistance including legal aid; medical and psychological assistance, tracing the family of underage victims of trafficking or their placement in a foster family or children’s home and helping victims to find a permanent job.

Finally, my delegation would like to reaffirm Viet Nam’s steadfast support for the peaceful settlement of the Israeli-Palestinian conflict and the realization of two States, Israel and Palestine, living side by side in peace, within secure and recognized borders, on the basis of the road map, the Arab Peace Initiative, the Annapolis understanding and relevant Security Council resolutions, including resolutions 242 (1967), 338 (1973), 1397 (2002), 1515 (2003) and 1850 (2008).

Expressing deep concern also about the Israeli policy of closures and the imposition of severe restrictions, checkpoints, several of which have been transformed into structures akin to permanent border crossings, and a permit regime, all of which obstruct the freedom of movement of persons and goods, including medical and humanitarian goods, throughout the Occupied Palestinian Territory, including East Jerusalem, and about the consequent violation of the human rights of the Palestinian people and the negative impact on their socio-economic situation, which remains that of a humanitarian crisis in the Gaza Strip, while taking note of recent developments with regard to the situation of access there

During this session, the SHS and SC Commissions examined the resolution proposed in document 35 C/COM SC/DR.1 (submitted by: Austria, Belgium, Plurinational State of Bolivia, Burkina Faso, Congo, Democratic People’s Republic of Korea, Denmark, Djibouti, Dominican Republic, Finland, Iceland, Libya, Lithuania, Luxembourg, Madagascar, New Zealand, Netherlands, Norway, Palau, Papua New Guinea, Poland, Portugal, Samoa, Senegal, Slovenia, Sweden, Tuvalu, Uruguay; co-sponsored by: Barbados, Costa Rica, Germany, Kazakhstan, Latvia, Lebanon, Malaysia, Monaco, Pakistan, Solomon Islands, Suriname, and Zambia), requesting the Director-General to strengthen UNESCO’s specialized capacity on climate change, building upon UNESCO’s unique interdisciplinary profile.

The State party should further develop and strengthen ongoing educational programmes to ensure that all officials, including judges and prosecutors, public inspectors of places of detention, law enforcement personnel, security officers, members of the Village Guards and prison and immigration officials, are fully aware of the provisions of the Convention, the absolute prohibition of torture and that they will be held liable for any actions in contravention of the Convention.

Its findings call for long-term investment in social science capacitybuilding and point to disparities in research capacities in the world and set a new global agenda to promote social sciences as an invaluable tool for the advancement of all Internationally Agreed Development Goals, including the Millennium Development Goals (MDGs).

This should include support for efforts to promote literacy, including functional literacy, formal and non-formal education, beginning with early childhood and continuing on a lifelong basis, education in the mother tongue in the early stages of learning, values education including social and moral awareness, the development of a culture of dialogue, a commitment to a culture of peace, education for sustainable development, teacher training, technical and vocational education and training (geared towards enhancing employability and drawing on the expertise of UNEVOC) as well as science and technology education.

The new Constitution (ratified on 7 August 2008) guarantees civil and political rights and fundamental freedoms including, inter alia: the right to life; right to nondiscrimination; right to fair and public trials; protection from arbitrary detention; right to bail; freedom from forced confession; right to legal aid; prohibition of torture or degrading treatment; right to appeal; access to compensation for unlawful arrest or detention; right to vote (voting age reduced to 18) and to hold public office; freedom of opinion and expression; right to privacy; right to information; freedom of association; freedom of assembly; freedom of movement; and provision of special protection to vulnerable groups, including children, adolescents, elders, and people with special needs.

It also considered the issue from a more general point of view in resolution 1373 (2001) on threats to international peace and security caused by terrorist acts (the Council “[noted] with concern the close connection between international terrorism and transnational organized crime, illicit drugs, money-laundering, illegal arms-trafficking, and illegal movement of nuclear, chemical, biological and other potentially deadly materials”) and in the presidential statement (S/PRST/2009/32) on peace and security in Africa (“the Security Council notes with concern the serious threats posed in some cases by drug trafficking and related transnational organized crime to international security in different regions of the world, including in Africa”).

South-South cooperation is a manifestation of solidarity among peoples and countries of the South that contributes to their national well-being, national and collective self-reliance and the attainment of internationally agreed development goals, including the Millennium Development Goals.

In accordance with article 4 of the Law No. 140-XV from 10.05.2001, Labour Inspection, as part of its competences, organises controls on accurate application of labour remuneration and has the right to request and to receive necessary information related to the exercise of its functions from central and local public administration authorities, from legal entities and physical persons and to impose administrative sanctions, as provided by law, including fines, for breach of legislative acts and other normative acts related to working conditions and protection of employees during the exercise of the functions.

The Commission commended the secretariat for the successful regional preparatory activities in the lead-up to the High-level Meeting, including its efforts to ensure an inclusive preparatory process that had resulted in a high level of engagement of governments and stakeholders, including organizations of persons with disabilities.

The Ministry is working to codify legislation that takes account of constitutional and international provisions on human rights (Nationality Code, act on people living with HIV/AIDS), the need to improve the functioning of the courts (act on personal status courts, act instituting judges responsible for the execution of sentences, legislation being developed to change the Supreme Court to a court of cassation, decree on the status of prison officials, etc.) and to revitalize the work of the members of the judiciary (Status of the Judiciary Act) with the aim of improving the efficiency of the legal system and access to justice.

The past eight years of terror and the period of so-called calm have taught us that any arrangement must be fully respected and secured, including the total cessation of rocket fire and smuggling, in order to be durable and to allow the possibility of lasting peace.

The Commission took note of the note by the Secretary-General, transmitting the report prepared by the Commission, on the economic and social repercussions of the Israeli occupation on the living conditions of the Palestinian people in the Occupied Palestinian Territory, including East Jerusalem, and of the Arab population in the occupied Syrian Golan (A/66/78-E/2011/13), and noted with appreciation the efforts of the secretariat to support the Palestinian people, build their institutions and raise awareness of Palestinian rights as guaranteed by numerous international resolutions, charters and conventions.
