In accordance with article 11 of the Rules and Regulations, claims are eligible for inclusion in the Register if: (a) the claimant is a natural or legal person; (b) the claimant has substantially met the technical requirements for submitting a claim; (c) the claim is within the jurisdiction of the Register of Damage; (d) the claimant has established a legal interest in the claimed damage; (e) the claimed damage is material; (f) the claimant has established a causal link between the claimed damage and the construction of the Wall in the Occupied Palestinian Territory; (g) the claimed damage was in fact sustained; (h) thedocuments and assertions in support of the claim are substantially consistent; and (i) the claim has been established prima facie, based on the information and documents submitted by the claimant, giving the claimant the benefit of the doubt in appropriate cases and bearing in mind the varying circumstances with regard to title and residency status of claimants.

I would appreciate if the present letter and its annex could be circulated as a document of the sixty-third session of the General Assembly, under agenda items 15, 16, 29 and 65 (c), of the tenth emergency special session of the General Assembly under agenda item 5, illegal Israeli actions in Occupied East Jerusalem and the rest of the Occupied Palestinian Territory, and of the Security Council, under the item entitled “The situation in the Middle East, including the question of Palestine”.

For a number of reasons, it is not always possible to draft specific provisions in a suitable or discrete form, such as a convention or a model law, for incorporation into national legal systems: national legal systems often use widely disparate legislative techniques and approaches for solving a given issue, States may not yet be ready to agree on a single approach or common rule, there may not be consensus on the need to find a uniform solution to a particular issue, or there may be different levels of consensus on the key issues of a particular subject and how they should be addressed.

It is also understood that the Special Committee should continue to be guided by the relevant provisions of the plan of action for the Second International Decade for the Eradication of Colonialism for the period 2001-2010 (A/56/61, annex), declared by the General Assembly in its resolution 55/146, and resolution 60/120 on the Second International Decade for the Eradication of Colonialism.

Republic of Moldova adopted a list of normative acts that regulate the migration processes, the status of foreign citizens and stateless persons present on the territory of the country: Civil Procedure Code of the Republic of Moldova (art. 454–456) and the Civil Code of the Republic of Moldova (Fifth part), Law on migration, Law on the status of foreign citizens and stateless personsin the Republic of Moldova, Law on the status of refugees, Law on departure and entry in the Republic of Moldova, Rules on stay of foreign citizens and stateless persons in the Republic of Moldova, Government Decision on temporary employment of migrant workers, Regulations on education of foreign citizens and stateless persons in the educational institutions of the Republic of Moldova.

Furthermore, the report of the High-level Panel on Threats, Challenges and Change (A/59/565) and the report of the Secretary-General “In larger freedom: towards development, security and human rights for all” (A/59/2005) proposed a number of initiatives of vital importance to millions of women and girls in conflict and post-conflict areas, including: the creation of a Peacebuilding Commission; increased focus on conflict prevention; the responsibility to protect populations from genocide, war crimes, ethnic cleansing and crimes against humanity; more effective protection of human rights; and enhanced rule of law.
