In accordance with rule 71, paragraph 5 of the HR Committee’s rules of procedure, Honduras should provide, within one year, relevant information on the assessment of the situation and the implementation of the recommendations in paragraphs 9 (children’s deaths), 10 (use of force by officials), 11 (street children) and 19 (indigenous communities and Agrarian Reform Act).135 A partial response was received in 2007; additional information was requested in 2009.

For the purposes of the present article, torture means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.

During the trial proceedings, the authorities arrested Javid Houtan Kiyan, her defence attorney, and Sajjad Qaderzadeh, her son, and also aired her confession on television, which raised serious concerns about the fairness of the trial proceedings.
