The consultation was opened by H. E. Pham Gia Khiem, Vice Prime-Minister of the Socialist Republic of Viet Nam, who reviewed the positive state of cooperation between his country and UNESCO.

It was also suggested that FAO should undertake technical work in the following five priority areas to assist States and RFMOs implement resolutions 61/105 and 64/72 and the FAO Guidelines: (i) improving and expanding application of the criteria for the identification of VMEs beyond corals, sponges, seamounts and hydrothermal vents; (ii) developing guidance on impact mitigation measures and best practices for developing and applying encounter protocols relevant to VMEs, particularly by RFMOs; (iii) developing guidance on what and how information should be collected to implement measures for managing fishery impacts on VMEs; (iv) defining certain terms that could clarify implementation of the FAO Guidelines; and (v) developing guidance on best practices for conducting assessments.

It was felt that the reference to “neutrals” was, as a matter of drafting, imprecise, as it was not clear whether it referred to formal neutrality or mere non-belligerency.

If there are no such instructions or decisions, a decision whether to avoid granting medical treatment to the terminally ill patient will be made by the responsible physician, having had consideration of an implicit testimony from the patient’s relative, and in the absence of such relative, considering the position of the patient’s guardian (section 4b (1) and (2)).

In reaching their verdicts, the courts relied as evidence primarily on confessions by the defendants, which the defendants said they were forced to make under torture and ill-treatment and which they retracted in court.
