Following the adoption by the General Assembly of a new system of remuneration for judges of the International Court of Justice (decision 62/547 of 3 April 2008) based on the post adjustment mechanism, the nineteenth Meeting of States Parties decided on 26 June 2009 to set the annual net base salary of the members of the Tribunal at $161,681 as of 1 July 2009, with a corresponding post adjustment multiplier equal to 1 per cent of the net base salary, to which would be applied the post adjustment multiplier for Hamburg, as appropriate, taking into account the post adjustment mechanism as proposed by the Secretary-General in paragraph 77 of his report on conditions of service and compensation for officials other than Secretariat officials (A/62/538).1 21.

The recosting reflected in the report of the Secretary-General on the effect of changes in rates of exchange and inflation on the proposed budgets of both the International Criminal Tribunal for Rwanda and the International Tribunal for the Former Yugoslavia for the biennium 2010–2011 (A/64/570) reflects the impact of the latest data on actual inflation, the outcome of salary surveys, the annual cost-of-living adjustments, the movement of post adjustment indices in 2009 and the effect of the evolution of operational rates of exchange in 2009.

The staff retreat held during the review period identified those regions and subregions where serious gaps exist: in Africa (e.g. in eastern and southern Africa, including the Indian Ocean Island States); in Asia-Pacific (e.g. in Central Asia and in the Small Pacific Island States); in Latin America and the Caribbean (especially the Small Caribbean Island States); and in Europe (especially in Central and Eastern Europe).

In accordance with the approved methodology, ICSC carries out an annual review of Post Adjustment to check that international Professional salaries in duty stations away from New York (i.e. the base of the salary system) have the same purchasing power as those received by equivalent staff in New York; and to make adjustments, where necessary.

However, the amount would be adjusted prior to the adoption of the outline to include the latest amendments proposed by the Advisory Committee and the Fifth Committee and recosting based on the updated parameters applied in the first performance report on the programme budget for the biennium 2010-2011 (A/65/589) in respect of operational rates of exchange, actual inflation experience, payroll experience and the movement of post adjustment multipliers and cost-of-living adjustments.

A new subparagraph (b) is inserted, which reads as follows: “If the member has served for more than nine years, he/she shall receive one three-hundredth of his or her retirement benefit for each further month beyond nine years, up to a maximum pension of two thirds of the amount of the annual net base salary (excluding post adjustment).

(b) A staff member who is entitled to salary at the dependency rate shall be paid post adjustment calculated on the basis of such salary regardless of where the dependants reside.

This has had certain negative impacts on the Authority and its staff: the Authority is unable to contribute to the process of establishing some of the basic conditions of service for staff, such as post adjustment, and is also unable effectively to avail itself of the benefits of the Inter-Organization Agreement and related staff mobility and career enhancement mechanisms, as well as the services of the Joint Inspection Unit and security management services coordinated through the Department for Safety and Security of the United Nations.

(a) Staff costs: Changes in the post adjustment multipliers for international Professionals, as well as staff entitlements, result in a decrease of $11.6 million in the projected standard costs of international posts.

These are statutory and non-discretionary cost increases representing: (a) the impact of inflation and currency adjustments; (b) cost adjustment related to posts, including salary scale revisions, with in-grade salary increments, post adjustments and other entitlements determined by the International Civil Service Commission; and (c) provision for ASHI for existing staff members.

(d) The amount of the special post allowance shall be equivalent to the salary increase (including post adjustment and dependency allowances, if any) which the staff member would have received had the staff member been promoted to the next higher level.
