The 63rd meeting considered the 2011-2014 consolidated business plan of the Multilateral Fund, and after making some amendments to the projects proposed, the Executive Committee endorsed the 2011-2014 consolidated business plan while noting that endorsement denoted neither approval of the projects identified therein nor their funding or tonnage levels; established a window for ODS destruction for LVC countries, pursuant to decision XXI/2 of the Twenty-first Meeting of the Parties, amounting to US $3 million; and decided that the project preparation could be funded for stage II HPMP activities and 12 might be included prior to the completion of stage I in business plans for the years 2012-2014 and that the duration of the next business plan should be only for the next triennium 2012-2014, and include any multi-year funding after 2014 (decision 63/5).

These include, inter alia, market drivers (for example, very specific market windows that require the appropriate combination of technical and business skills to access fully); consumer issues (for example, importing markets requiring specific certifications impacting production practices); infrastructure and installed capacity (for example, sufficient airfreight, cold room facilities); and large enough consumption of a given material or product to develop a market for it and ensure availability, and others.

ICAPP had also supported efforts to enhance international security in keeping with the Final Document of the 2010 Review Conference of the Parties to the Treaty on Non-Proliferation of Nuclear Weapons, particularly the participants’ call for States to make special efforts to establish the necessary framework to achieve and maintain a world without such weapons, and with the Secretary-General’s five-point proposal on nuclear disarmament, which had urged States to consider negotiating a nuclear weapons convention.

Although the author acknowledges that the courts can, while sentencing someone, make an order for “preventive” reasons, his case was different as the orders for his continued detention were not contemplated at the time of sentencing.

Real signs of improvement had been seen in the conditions of indigenous peoples, victims of violence and past abuses, and the institutional promotion of human rights in the country.

In the legal framework, the role of MPAs has been defined as “protection, on a scientific basis, for current and future generations, of important natural and cultural resources and ecosystems representative of the marine environment”.

It is in that same context that, as members of the Council and from our national perspective as a State party to the Court, we cannot turn a blind eye to the suffering caused to the population and the serious acts committed in Darfur since 2003, as well as to the recent investigations that detail systematic and lamentable facts, which by any measure constitute crimes against humanity.

Those resolutions include Security Council resolution 487 (1981) and, in particular, paragraph 5 thereof, which calls upon Israel urgently to place its nuclear facilities under the safeguards of the International Atomic Energy Agency; the two IAEA resolutions Nos. GC(53)/RES/17, adopted in 2009, entitled Israeli nuclear capabilities, and GC(55)/RES/14 of 2011, entitled Application of IAEA safeguards in the Middle East; and General Assembly resolution 66/61 of 2011, entitled The risk of nuclear proliferation in the Middle East, which recalls that Israel remains the only State in the Middle East that has not yet become a party to the Treaty on the Non-Proliferation of Nuclear Weapons and reaffirms the importance of Israel’s accession to the Treaty and placement of all its nuclear facilities under comprehensive IAEA safeguards.

In the sixth sentence, replace the words “illicit trafficking in and manufacture of small arms” with the words “illicit manufacture of and trafficking in small arms”.

Still on the subject of the English version, though not in relation to a term used in the previous texts, since it does not appear in them, we feel that an unfortunate adjective is used in the heading of section II B.3: perhaps the phrase would be equally satisfactory with the deletion of the word “substantive”.

(c) Any act of voluntary participation in the operation of a ship or of an aircraft with knowledge of facts making it a pirate ship or aircraft or of inciting or intentionally facilitating an act of piracy may, in accordance with the Criminal Code, be dealt with as complicity in the commission of the offence constituted by the specific act in question (articles 25, 26, 27 and 29); acts inciting piracy may also constitute the offence of passing on criminal methods (article 295).

In describing the potential of MOST, the Council agreed that MOST relies on, inter alia: being an international platform that mobilizes Member State’s support for social sciences in their countries; being a resource that in a highly visible way creates demand and awareness in policymakers of their need for social science research in policy formulation; having the responsibility to promote and support capacity-building initiatives, particularly on systemic issues that require government action; the illustration of the credibility and relevance of MOST’s objectives by working through a select number of globally-significant social transformations, in accordance with Main Lines of Action 2 and 3 in Major Programme III on Social and Human Sciences of 36 C/5; and, encouraging participatory processes, engaging with civil society, and creating greater sensitivity to the need for social sciences.

(g) Bearing in mind the need to maintain budget discipline, to use conferences services in a cost-effective manner and to conduct its work more efficiently, the Commission requests the Secretariat to provide a report related to documentation prepared for the Commission, including the costs and the number and frequency of issuance of those documents, the efforts made by the Secretariat to find internal efficiencies in the manner in which it produces such documents and the savings linked to those efficiencies, as well as recommendations on these issues, including exploring possibilities to further improve and reduce the yearly reporting requirements through a thorough examination of its current mandates, with a view to identifying outdated or duplicative mandates.

As regards calculation of time actually worked, for purposes of application of those coefficients no account is taken of absence from work other than absences on medical grounds in respect of ordinary or occupational disease, accident - work- or non-workrelated - suspension of the employment contract for maternity, adoption, care or risk during pregnancy; and absences authorized as qualifying for payment under the relevant labour legislation.

I also look forward to the innovations that adopting Ethernet will make possible; we will soon be able to remove the need for additional I/O cards as Ethernet gives us a solid foundation for future developments.

The OIC recalls paragraph 4 of resolution 2/36PAL, adopted at the thirty-sixth ministerial meeting of the OIC in Damascus, in which the members reaffirmed that all the Israeli colonial settlement measures and practices in Al-Quds and the rest of the occupied Palestinian territory are null and void, in line with the resolutions of international legitimacy, as well as international covenants and conventions that consider all Israeli legislative, administrative and colonial settlement procedures and measures aimed at altering the legal, demographic, architectural, cultural and heritage-related status of the holy city to be illegitimate.

As noted above, aside from the legal and administrative aspects, compulsory licensing will only be effective if the compulsory licensee sees the possibility of a reasonable return from his investment while also supplying at a significantly lower price than the patentee (or his licensee).

The State party should, in particular, publicly and unambiguously condemn practices of torture in all its forms, directing this especially to police and prison staff in positions of command responsibility, accompanied by a clear warning that any person committing such acts, as well as instigating, consenting or acquiescing in torture or other ill-treatment, will be held personally responsible before the law for such acts and subject to penalties proportional to the gravity of their crime.

Noting with concern measures that can undermine human rights and the rule of law, such as the detention of persons suspected of acts of terrorism in the absence of a legal basis for detention and due process guarantees, the deprivation of liberty that amounts to placing a detained person outside the protection of the law, the trial of suspects without fundamental judicial guarantees, the illegal deprivation of liberty and transfer of individuals suspected of terrorist activities, and the return of suspects to countries without individual assessment of the risk of there being substantial grounds for believing that they would be in danger of subjection to torture, and limitations to effective scrutiny of counter-terrorism measures

It would be useful to distribute those papers in CD-Rom form to United Nations Member States, as that research helped to illustrate that, were it not for the Israeli occupation, Palestine would not be a failed State but a vibrant economy which deserved to gain independence and become a full member of the United Nations.
