The activities of nongovernmental organizations and other private actors, sometimes collectively referred to as “civil society” actors, are included within the scope of the draft articles only in a secondary manner, either as direct beneficiaries of duties placed on States (for example, of the duty of States to cooperate, in article 5) or indirectly, as being subject to the domestic laws, implementing the draft articles, of either the affected State, a third State or the State of nationality of the entity or private actor.

Five principles should inform the review: (a) local women and national gender experts should be consulted, and their views reflected, in all planning processes; (b) the analysis of needs and priorities should be based on an appreciation of the differential impact of conflict on women and men and boys and girls, and of the potential for prevailing gender relations to affect efforts to rebuild effective and equitable institutions; (c) resource allocations should be based on projections of the gender implications of competing funding scenarios; (d) gender-related outcome indicators and costed activities should be included in planning frameworks; and (e) sufficient expertise in social and gender analysis should be provided throughout the planning process to allow these steps to be implemented effectively and within the stipulated time frames.

In its resolution 1970 (2011), the Council decided that the travel ban and asset freeze should apply to the individuals and entities designated by the Committee (a) involved in or complicit in ordering, controlling or otherwise directing, the commission of serious human rights abuses against persons in Libya, including by being involved in or complicit in planning, commanding, ordering or conducting attacks, in violation of international law, including aerial bombardments, on civilian populations and facilities, or (b) acting for or on behalf of or at the direction of individuals or entities identified in subparagraph (a).

The success of peacebuilding activities on the ground requires that government and international agencies develop a fine-grained understanding of the dynamics to ensure that their interventions first do no harm, and secondly can be as effective as possible.

The report also confirmed once again Israel’s continuing practice of confiscating the private property of Syrian citizens in the occupied Golan, plundering its natural resources, including water resources, and creating settlements throughout the Golan and Palestine, using water as a means of exerting pressure on the Syrian population of the Golan, bulldozing and destroying their land, uprooting their fruit trees, blockading them economically and imposing exorbitant taxes on them, particularly on agricultural workers.

In this regard, I wish to draw your attention to the following illegal actions perpetrated by Israel, the occupying Power, in the Occupied Palestinian Territory, including East Jerusalem, and to reiterate the appeal of the Palestinian people and their leadership to the international community, including the Security Council, to uphold its legal obligations and responsibilities and to act forthwith to bring an end to this unlawful and dangerous situation and to salvage the prospects of realizing a just, comprehensive and lasting peace settlement by which, inter alia, the Palestinian people will realize their right to self-determination and freedom in their independent, sovereign, democratic, contiguous and viable State of Palestine, with East Jerusalem as its capital, on the basis of the pre-1967 borders.

Some delegations expressed the view that it was not appropriate for the Executive Committee to take a decision on the Recommendations as the evaluation was clearly the responsibility of the Commission and all members should have the possibility to express their views in this respect.

Jordan has great hopes for the sincere and extensive efforts of the Security Council and appreciates the Egyptian initiative, which should serve as an incentive to make progress in ending this tragic situation, by providing humanitarian assistance to the brotherly Palestinian people, alleviating their suffering and returning to serious negotiations in order to achieve the two-State solution, which is the only way to ensure security and stability in the region.

International action in the field of refugee protection should focus on the following four areas: eliminating the causes of conflicts in the world, including by improving States’ capacities for development; promoting respect for international refugee law, in complementarity with international humanitarian and human rights law, and ensuring that refugees’ human rights were not negatively affected by security or migration concerns; promoting international solidarity and partnerships and assisting States emerging from conflict to build their institutional capacities in order to take care of their citizens; and encouraging refugees’ voluntary repatriation to their home countries by financing national programmes, while strengthening international efforts, particularly the role of the Peacebuilding Commission.

Taking the above into consideration, we can enumerate some of the entities that fulfil the requirements of the statute to be regarded as public entities including: the organs of public authorities, including organs of government administration; state control, law enforcement bodies and their associations; municipality; country and provincial authorities; entities financed by the state; and the local government (including other central or local government legal people created under separate legislation for the purpose of performing public tasks), with the exclusion of enterprises, banks and commercial companies.

The Committee requests the State party to include information in its next periodic report on the conditions of work of prisoners performing labour for private companies as well as on the measures taken to safeguard their labour rights, such as inspections.

Indeed, in addition to illegally confiscating land and constructing settlements, Israel continues to apply a host of other illegal measures aimed at driving out the indigenous Palestinian population, including the demolition of homes (the occupying Power has demolished at least 31 Palestinian residential buildings, leaving 106 Palestinian civilians, including 61 children, homeless since the start of this year), the revocation of residency rights, the continued closure of Palestinian institutions in the city and the recent decision to ban social activists from travelling to other parts of the West Bank, effectively severing them from their work and familial relations with their natural surroundings.
