Section II, title X, article 328 of the Family Code states: “When the health, safety, morality or education of a minor are jeopardized or insufficiently protected owing to the immoral behaviour or disability of the father and mother or of the person accorded the right of guardianship, or when, owing to misconduct or unruly behaviour, a minor gives these individuals cause for very serious dissatisfaction or renders them incapable of exercising guidance, the juvenile judge may on his own initiative, at the behest of the public prosecutor or at the behest of the father, mother or guardian, rule that the minor shall, for a period not to extend beyond the date of his coming of age, be visited regularly by a social worker or placed on probation.

In paragraph 63 of his report (A/64/380), the Secretary-General provides information on a number of related initiatives being implemented concurrently with ERP within the United Nations Secretariat and missions, including: IPSAS implementation, the talent management system (recruitment and staffing), Lean SixSigma (non-systems process improvement), enterprise content management and customer relationship management, as well as a fuel management system and a rations management system for peacekeeping functions.

By creating a Community of unlimited duration, having its own institutions, its own personality, its own legal capacity and capacity of representation on the international plane and, more particularly, real powers stemming from a limitation of sovereignty or a transfer of powers from the States to the Community, the member States have limited their sovereign rights, albeit within limited fields, and have thus created a body of law which binds both their nationals and themselves.

All natural persons have the same legal personality and enjoy the same legal capacity, irrespective of gender.

A range of other suggestions was put forward, such as: to ensure the preservation of digital heritage, including archives and libraries as a component of the “Memory of the World Programme”; to develop media education programmes for children and adults; and to increase familiarity with the use of ICTs, especially within the framework of the knowledge society and knowledge economy, in light of the outcomes of the World Summit on the Information Society.

Equally relevant are the Convention on the Elimination of All Forms of Discrimination against Women, article 12, concerning the obligation of States to eliminate discrimination against women in health care; the Convention on the Rights of Persons with Disabilities, article 25 (b), which requires that health services be “designed to minimize and prevent further disabilities, including among children and older persons”; and the International Covenant on Civil and Political Rights, article 7, which prohibits torture or cruel, inhuman or degrading treatment or punishment and includes the prohibition of medical or scientific experimentation without free consent.

The Commission had reminded the department of the need to be more vigilant in processing other similar cases in the future.

The new Constitution (ratified on 7 August 2008) guarantees civil and political rights and fundamental freedoms including, inter alia: the right to life; right to nondiscrimination; right to fair and public trials; protection from arbitrary detention; right to bail; freedom from forced confession; right to legal aid; prohibition of torture ordegrading treatment; right to appeal; access to compensation for unlawful arrest or detention; right to vote (voting age reduced to 18) and to hold public office; freedom of opinion and expression; right to privacy; right to information; freedom of association; freedom of assembly; freedom of movement; and provision of special protection to vulnerable groups, including children, adolescents, elders, and people with special needs.

Further to this meeting, the Bureau of Human Resource Management is now working with two non- and under-represented Member States to determine the specific causes for non/under-representation and identify concrete measures that could be taken by all parties concerned to address these causes.

These safeguards are considered not so much as due process safeguards — this task falls to other United Nations bodies — but as instruments of prevention of torture and other cruel, inhuman or degrading treatment or punishment.

Reiterating that the burden of proof was not placed on the accused in cases of torture, he said that, in accordance with the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol), judges were authorized to take any steps necessary to ascertain the facts in allegations of torture.
