The immediate impact of intellectual property protection is to benefit financially those who have knowledge and inventive power, and to increase the costs of access to those without.

By contrast, it might also be argued that intellectual property owners and licensors could achieve an equivalent result by ensuring that they or their secured creditors: (a) obtained a security right in or an outright assignment of a right to payment of a percentage of the sub-royalties payable to the licensee as a sub-licensor by sub-licensees and registered a notice thereof in the relevant intellectual property registry before any registration in that registry by a secured creditor of the licensee; (b) obtained a security right in or an outright assignment of a right to payment of a percentage of the sub-royalties payable to the licensee as a sub-licensor by sub-licensees and registered first a notice thereof in the general security rights registry; or (c) obtained a subordination agreement from the secured creditor of the licensee.

ILO Convention No. 29 also provides that the term “forced or compulsory labour” shall not include any work or service exacted from any person as a consequence of a conviction in a court of law, provided that the said work or service is carried out under the supervision and control of a public authority and that the said person is not hired to or placed at the disposal of private individuals, companies or associations (Art 2 (c)).

The SPT recommends that all persons deprived of their liberty by the police are systematically informed, as from the outset of such deprivation, about their right of access to a lawyer or other trusted third party, and are provided with the means necessary to consult in private with a lawyer or other trusted third party.

The Committee has previously noted that some of those posts are subject to a quick turnover and has stressed the importance of making efforts to obtain the sustained commitment of those entities to provide assignments of seconded personnel of longer duration, in order to ensure stability of functions (A/64/7, para. Over the course of just a few days, Iran’s Supreme Leader called Israel a “cancerous tumor in the heart of the Middle East”; its President called on “all human communities to wipe out [Israel] from the forehead of humanity”; and the head of its Aero-Space Forces threatened to “wipe [Israel] out of the map”.

Such barriers would be examined not only as static conditions, but also as dynamic processes at the level of the individual, i.e., lifecourse changes, and at the level of communities and nations, i.e., demographic and economic transformations.

In many of the countries affected by humanitarian crises or recovering from emergencies, there is a need to develop more flexible inter-agency approaches and tools taking into account capacity gaps and the transition from humanitarian to development contexts.

The Committee encourages the State party to continue its efforts to combat trafficking of human beings, and in particular it recommends the adoption of a national strategy from a human rights perspective, to combat the trafficking of human beings and to address the exploitation resulting from this practice.
