The finalized arrangements were largely the same as originally proposed in that there would no longer be pure bifurcation of schools into schools using English (EMI schools) and Chinese (CMI schools) as the medium of instruction; schools would be given full discretion to determine its MOI arrangements if the average proportion of Secondary One intake admitted to a class belonging to the "top 40%" group in the previous two years reached 85% of the size of the class; other schools adopting mother tongue for teaching content subjects could use 25% of the total lesson time for extended learning activities (ELA) in English; and schools could transform the ELA time into the adoption of EMI for individual subjects, up to a maximum of two subjects.

It was not practicable from law enforcement point to accept wordings in the Chinese rendition that were not provided by the legislation.

4.8 The State party asks the Committee to note how similar the facts and situations described by the authors are and to take into account the socio-political and security context at the time; to note that the authors failed to exhaust all domestic remedies; to note that the authorities of the State party have established a comprehensive domestic mechanism for processing and settling the cases referred to in these communications through measures aimed at achieving peace and national reconciliation that are consistent with the principles of the Charter of the United Nations and subsequent covenants and conventions; to find the above-mentioned communications inadmissible; and to request the authors to avail themselves of the appropriate remedy.

Taking account of the increasing use of ERAs and the twin aims of harmonization and promotion of best practice, the Working Group agreed: (i) to include in the revised Model Law a general enabling provision providing the key principles for the use of ERAs, notably the conditions for and limitations to the use of ERAs; (ii) to confine ERAs under the Model Law to some types of purchases for which non-price criteria could be quantified, specifications could be provided and a competitive market existed; (iii) to address in the Guide the use of ERAs in detail; and (iv) to take into account the approach of the multilateral Government Procurement Agreement of the World Trade Organization as regards the use of ERAs (A/CN.9/575, paras. 60-62, 66 and 67).

Appropriate measures by the State to facilitate provision will depend on the local context and might include steps to formalize the legal status of settlements, guarantees that people will not be forcibly evicted, the provision of financial assurances, and, in some circumstances, resettlement to an alternative area as long as human rights standards are respected.35 Where the issue of the lack of security of tenure has not yet been resolved, States should at least take measures to ensure that the informal service provision that often prevails in such areas meets minimum human rights standards, as further outlined below, or that innovative solutions to providing formal services are implemented.

In the case of a joint account where the Principal Cardmember or the Supplementary Cardmember is one of the joint account holders, Hang Seng may exercise the rights in Clause 28(a) and apply any credit balance on such joint account in or towards satisfaction of any indebtedness owing to Hang Seng by such Principal or Supplementary Cardmember.

Furthermore, as noted in paragraph 2 above, pursuant to General Assembly resolution 63/266, the Secretary-General has included in his report a projection of the total budget for special political missions for the biennium 2010–2011, which he estimates could amount to some $1,148,739,700, or $319,811,300 more than the provision for special political missions in the proposed programme budget for the biennium 2010–2011 (see A/64/349, para. 78 and annex III).
