The Government of Azerbaijan is not in a position to pass over in silence the indiscriminate attacks and the intentional killings committed by the Armenian side in the course of war and is determined to continue to make strenuous efforts to update the international community about the flagrant violations of the common norms and principles by the armed forced of the Republic of Armenia and bring all those responsible for these crimes to justice.

Haitians may have died in their thousands, and so many Haitians may have been consigned to the grave, yet the indomitable spirit of the living remains undaunted and undeterred as to what the future holds.

But it is also true that the strength and resilience of the human spirit, if fully harnessed, can make the impossible possible and the difficult easy.

We are convinced that Afghanistan, with its brilliant historical and cultural heritage, will, and must, persevere in facing its multiple current domestic and foreign challenges and transform itself into a prosperous, secure and democratic country in all respects.

Before turning to the Secretary-General’s report (S/2010/169), I want to emphasize that the principled position of Serbia’s democracy remains set in stone.

In paragraphs 1969 (c) and (e) of its report, the Mission further recommended that “upon receipt of the committee’s report, the Security Council should consider the situation and, in the absence of good-faith investigations that are independent and in conformity with international standards having been undertaken or being under way within six months of the date of its resolution under Article 40” by the appropriate authorities of the State of Israel or the relevant authorities in Gaza, respectively, “acting under Chapter VII of the Charter of the United Nations, refer the situation in Gaza to the Prosecutor of the International Criminal Court pursuant to article 13 (b) of the Rome Statute” of the International Criminal Court.

On the legal and drafting aspects, the Bills Committee notes its legal adviser's comment that since the obligation imposed on the MPFA to pay a special contribution under the proposed section 19B(1) does not appear to be mandatory, an aggrieved person may not have a cause of action against the MPFA if it has failed to pay the special contribution into that person's relevant account or has paid the sum to a wrong account.

The decision of the International Criminal Court will not justify any change in the obligation of the Government of the [...] [...]

It will be important that a similar message of support be communicated to the brave and resilient people of Haiti from our collective deliberations in the Security Council today.

We are steady in our resolve and intend to come through the current industry crisis in better shape than ever, poised to resume the successful growth of the airline once economic conditions show signs of improvement.

We feel their pain and sorrow and express our hopes that with resilience and strength they will be able to overcome this exceptionally tragic moment.

That action testifies to a more active commitment to the cause of that brave people, whose resilience and courage serve as an example to all peoples of the world and a source of inspiration for the exercise of the right to self-determination.

The establishment of an international criminal jurisdiction that is impartial, non-selective, effective, fair, complementary to national justice systems, genuinely independent, and therefore free of subjugation to political interests that might erode its essence, continues to be an objective that Cuba supports.
