This has been found to be fundamentally unsound and potentially dangerous for the Fund.

(E) The Board may on any occasion when it makes a determination pursuant to paragraph (A) of this Bye-law, resolve that no allotment of shares or rights of election for shares to be issued pursuant to such determination shall be made available or made to any shareholders with registered addresses in any particular territory or territories or to a Depositary where the allotment of shares or the circulation of an offer of such rights of election would or might, in the opinion of the Board, be unlawful or would or might, in the opinion of the Board, be unlawful in the absence of a registration statement or other special formalities, and in such event the provision aforesaid shall be read and construed subject to such resolution and the only entitlement of shareholders in any such territory or territories shall be to receive in cash the relevant dividend resolved to be paid or declared.

A number of participants felt that they had been unable to consult all their technical commissions, given the late receipt of the questionnaire and also the unsuitability of the dates of the consultation.

10.2 Notwithstanding clause 10.1, nothing in these Terms and Conditions excludes, restricts or modifies any condition, warranty, right or liability implied into the contract between Dragonair and a Customer where to do so is illegal or would render any provision of the contract void.

This incompetence and unjustified delay demonstrate the ineffectiveness of the available remedy.

The Company may receive the consideration, if any, given for the share on any sale or disposition thereof and may execute a transfer of the share in favour of the person to whom the share is sold or disposed of and he shall thereupon be registered as the holder of the share and shall be discharged from all calls made prior to such sale or disposition, and shall not be bound to see to the application of the purchase money, if any, nor shall his title to the share be affected by any irregularity or invalidity in the proceedings in reference to the forfeiture, sale or disposal of the share.

The practice of anachronistic “resolutions” and the “special rapporteur” on the Democratic People’s Republic of Korea must no longer be tolerated in the Council.

A lack of transparency in that respect might (a) undermine trust and political support for individual public authorities and Government and State institutions in general, thus endangering the efficacy of public interventions and risking political instability; (b) provoke significant redistributions of wealth in ways that not only are unfair and, in some cases, possibly illegal, but also favour rent-seeking behaviour, act against fair competition and provide the wrong incentives for efficiency, innovation and competitiveness in general; and (c) prolong outdated practices and political institutions, including co-optation, corruption and the capture of public policies by specific industries or groups, delaying the modernization of State institutions and impeding overall economic, social and political development over the longer term.

It is not therefore very logical to grant an extension for one sector on the grounds of public health to a specific future date, when the criteria under TRIPS for granting extensions are far more broadly based.

Other reports have focused on contested or unclear areas of law, such as the relationship between human rights and humanitarian law, the circumstances in which the application of the death penalty is unlawful, and the legality of targeted killings.

He further clarifies that he sought costs against the party responsible for the unreasonable delay, that is, the Ministry of Justice rather than the respondent, the Health Board, who was not in fault in that respect.

It is essential to seriously work towards creating favourable market access conditions for all products originating in least developed countries, including through the reduction or elimination of arbitrary or unjustified non-tariff barriers and other trade-distorting measures.

Civil society is frustrated that, having caused massive costs in the LDCs through financial and food speculation, unjust trade rules, illegitimate loans with onerous conditionality, and ecological damage, including climate change, the developed countries have not even committed to provide more aid to LDCs.

11.3 Article 22, paragraph 5 (b), of the Convention precludes the Committee from considering any communication unless it has been ascertained that all available domestic remedies have been exhausted; this rule does notapply if it is established that the application of domestic remedies has been or would be unreasonably prolonged or would be unlikely to bring effective relief.
