Article 3 (2) reflects the realities that not all definitional issues could be dealt with adequately over the long span of a treaty’s life without some reference to the potentially more fluid and responsive laws of the parties to that treaty, and that treaties defining all terms would be potentially more complicated and harder to negotiate.
