This is no small task; attitudes towards children’s play range from dismissing it as a waste of time or something trivial, through restricting it as something dangerous or subversive, to appropriating it as a mechanism for learning or socialisation.

However, local courts retained jurisdiction to adjudicate any legal issue not decided by the Commission, and the Commission referred to local courts those issues which were connected to a claim but were not within its own jurisdiction.28 While it was provided that the decisions of both Commissions were legally binding in national courts and shall prevail over inconsistent findings of those courts as well as those of local administrations, there were numerous instances in which the Commissions’ competency and decisions were disregarded by national authorities.29

8.7 The Committee notes the author’s allegations of violation of presumption of innocence, as the authorities allegedly used national media to portray him as a criminal; his lawyers were given only limited time to study the evidence, and “obstacles” were added to examine the additional evidence presented by the prosecution; he had been judged already two times for malpractice in office but a third set of criminal proceedings was still pending at the time of submission of the present communication, on the same grounds; his request to be represented by a lawyer from Russia was ignored, though allowed under the legislation; NSS created additional obstacles for lawyers’ participation in the author’s case; and finally he was not allowed to examine witnesses against him in court, as the courts refused to call them without justifying their refusal.

The incitement spewed this week by Prime Minister Netanyahu, along with Israel’s escalating settlement campaign in the Occupied Palestinian Territory, including East Jerusalem and all other provocations as mentioned above require the serious attention of the international community.

Citizens could submit complaints about actions or omissions of the public authorities to the Ombudsman, who would investigate them and make recommendations to the competent bodies to prevent or redress cases of injustice.

As the Council’s meeting addresses the issue of nuclear-weapon-free zones, NAM reaffirms the need for the speedy establishment of a nuclear-weapon-free zone in the Middle East in accordance with Security Council resolution 487 (1981) and paragraph 14 of Council resolution 687 (1991) and the relevant General Assembly resolutions adopted by consensus; and, pending its establishment, NAM demands that Israel, the only country in the region that has not joined the Treaty on the Non-Proliferation of Nuclear Weapons or declared its intention to [...] [...]

It also considered the issue from a more general point of view in resolution 1373 (2001) on threats to international peace and security caused by terrorist acts (the Council “[noted] with concern the close connection between international terrorism and transnational organized crime, illicit drugs, money-laundering, illegal arms-trafficking, and illegal movement of nuclear, chemical, biological and other potentially deadly materials”) and in the presidential statement (S/PRST/2009/32) on peace and security in Africa (“the Security Council notes with concern the serious threats posed in some cases by drug trafficking and related transnational organized crime to international security in different regions of the world, including in Africa”).

By the same resolution, the Council decided that the mandate of the Force, in addition to carrying out its mandate under resolutions 425 (1978) and 426 (1978), would include, inter alia, monitoring the cessation of hostilities, accompanying and supporting the deployment of the Lebanese Armed Forces throughout southern Lebanon in parallel with the withdrawal of the Israeli Defense Forces, ensuring respect for the Blue Line and assisting the Lebanese Armed Forces in ensuring that the area between the Blue Line and the Litani River is free of any unauthorized armed personnel, assets and weapons, taking all necessary action within its capabilities to ensure that its area of operations is not utilized for hostile activities, and assisting the Government of Lebanon, at its request, in securing its borders and other entry points in order to prevent the entry into Lebanon without its consent of arms or related materiel.

Several Members reiterated that understanding, recalling decision 54/39(d), which stated (i) that approval of investment projects should result in a phase-out of HCFCs to count against the consumption identified in the HPMP, and that no such projects could be approved after 2010 unless they were part of the HPMP; and (ii) that, if the individual project approach were used, the submission of the first project should provide an indication of how the demonstration projects related to the HPMP and an indication of when the HPMP would be submitted.

At the same meeting, following a statement by the observer for Hungary (on behalf of the States Members of the United Nations that are members of the European Union and the associated countries), the Commission adopted draft resolution E/CN.5/2011/L.5/Rev.1, as orally corrected, and recommended it to the Economic and Social Council for its adoption (see chap. I, sect. A, draft resolution II).
