5.3 If you fail to comply with any of your obligations and/or to meet your liabilities under any of the provisions of this Client Agreement including this Schedule, including without limitation failure to provide Margin, we may at our absolute discretion and without prior notice to you or your consent; (a) decline to accept further Instructions in respect of Exchange Traded Options Business; (b) Close Out some or all of your Client Contracts with us; (c) enter into Contracts or transactions in Securities, Futures or Commodities, in order to settle obligations arising out to or to hedge the risks to which we are exposed in relation to your failure; and/or (d) dispose of the Margin or any part thereof, and apply the proceeds thereof to discharge your liabilities to us, and any proceeds remaining after discharge of all your liabilities to us shall be returned to you.

In its resolution 63/240, entitled “Towards an arms trade treaty: establishing common international standards for the import, export and transfer of conventional arms”, the General Assembly decided to establish an open-ended working group that would meet for up to six one-week sessions starting in 2009 in order to facilitate further consideration on the implementation of the relevant recommendation contained in paragraph 27 of the report of the Group of Governmental Experts to examine the feasibility, scope and draft parameters for a comprehensive, legally binding instrument establishing common international standards for the import, export and transfer of conventional arms (see A/63/334), on a step-by-step basis among all States Members of the United Nations, in an open and transparent manner.

On the other hand, only 1% of the graduates received a rating of 2 or below, implying that very few of them failed to meet employers’ required standard.

While some WTO members had underlined the positive aspects of private standards on quality and access to high quality markets, many other members had expressed the following concerns: the application of private standards at the import stage resulted in de facto barriers to trade, and created difficulties especially for developing countries; complying with these standards required multiple certification by private bodies, with a high cost for small producers; in many cases private standards were more restrictive and prescriptive than government standards and Codex standards and often had no scientific basis; the process by which private standards were set lacked transparency and inclusiveness; and in some cases such standards did not meet the requirements of the SPS Agreement.

The Committee also considered that States parties are under the obligation to meet at least the core minimum content of economic, social and cultural rights, which includes basic education.

Some delegations, while supporting the adoption of the criteria at Step 5, expressed the view that the development of the Draft and Proposed Draft Lists of Acceptable Cargoes should be discontinued for the following reasons: the criteria and the current Lists of Banned Immediate Cargoes were adequate to meet the dual mandate of Codex, there were no mechanisms allowing to maintain and update such lists on the basis of risk analysis principles; and the Committee should focus on careful consideration of the criteria.
