A.1 Each State Party to the present Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

The anti-discrimination law governs the implementation and compliance with the principle of equality on the grounds of gender, race, colour, ethnicity, gender identity, sexual orientation, political, religious, philosophical, economic, education or social status, pregnancy, parental affiliation, health status, domicile and others.

Legislation serves as a reminder of not to do what we all know is wrong and represents a social contract among all of us under which we will not deny one and other the opportunity to a better life because of colour, sex or age.

As regards to the recommendations to adopt measures to address all forms of discrimination, including based on sexual orientation, ethnicity, gender, colour, and political opinion, Botswana indicated that the Government maintains that Section 15 (3) of the Constitution of Botswana prohibits discrimination against any person on the grounds of race, tribe, place of origin, political opinions, colour, creed or sex, and as such any person who is of the view that their rights have been violated can at anytime seek redress before the High Court of Botswana.

The Delegation of the European Community, while not opposing the adoption of the Standard, expressed its strong reservation on the use of some additives, particularly acidity regulators, colours, preservatives and thickeners, as there was no technological justification for their use in the products covered by the Standard and these products were consumed in large amounts by certain population groups, especially children.

The State party also pointed out that the arrest warrant has been produced in colour, which is not a regular practice, and stressed that the procurement of false documents is fairly easy in the country.

(e) Please provide, as much as possible and as appropriate, figures and data concerning educational opportunities in your country (regarding literacy rate, gross enrolment ratio in primary education, secondary education in its different forms, higher education as well as drop out and completion rates, the number of participants in adult/continuing education programmes, out-of school children of compulsory school age and trained teachers), disaggregated on the grounds of discrimination prohibited by the Convention and the Recommendation (“race, colour, sex, language, religion, political or other opinion, national or social origin, economic condition or birth”).

Be it the member of an ethnic minority who is attacked or killed in the context of a conflict due to his or her minority status; the individual who is regularly and in a discriminatory manner subjected to stopping and searching, interrogations or arrests, solely because of his or her perceived religious or ethnic background; the migrant, the refugee or the asylum-seeker who faces daily discrimination due to his or her status as non-citizen; or the football player who is insulted because of his skin colour; all such instances unfortunately demonstrate that racism and xenophobia are not yesterday’s problems, but that they remain an immense challenge for today.

(4) In this section, “discriminatory” means affording different treatment to different persons attributable wholly or mainly to their respective descriptions by race, caste, place of origin, political opinions, colour, creed or sex whereby persons of one such description are subjected to disabilities or restrictions to which persons of another such description are not made subject or are accorded privileges or advantages that are not accorded to persons of another such description.

The African Group is gravely alarmed at the attempt to reintroduce a direct reference, in paragraph 6 (b), to discrimination on the basis of the undefined notion of sexual orientation, as this amendment is aimed at reinterpreting internationally agreed human rights instruments by equating discrimination on the basis of an undefined notion with other forms of discrimination that are universally recognized and clearly codified in international human rights instruments, such as race, colour, gender, ethnicity, nationality, religion and language.

The sponsors had also made three other changes to the revised text, in the hope that the draft resolution would be adopted by consensus: starting in the fourth line of the ninth preambular paragraph, the phrase “such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status” should be deleted; in the third line of the thirteenth preambular paragraph, the words “in particular” should be deleted; and in the third line of the fifteenth preambular paragraph, the words “in requesting countries” had been inserted after the words “election processes”.

Such factors could include the quality of the raw material, with the object of protecting the health of the consumer, provisions on taste, odour, colour and texture which may be apprehended by the senses, and basic quality criteria for the finished products, with the object of preventing fraud.
