It should be noted that, if creation is distinct from third-party effectiveness and is referred by A and SC1 to the law of State X (law of the State of the grantor’s location) and by A and SC2 to the law of State Y (the protecting State), no major problem would arise as long as the priority conflict between SC1 and SC2 is referred to one law, in this example, to the law of State Y, the protecting State (see, however, para. 29).

The interpretation of the decision indicates that as long as an Article 5 Party has an agreement with the Executive Committee to reduce emissions from the process agent applications listed in TableAof decision X/14 of the Meeting of the Parties, the production and consumption associated with these process agent applications should be excluded from the calculation of the annual production and consumption of the controlled substances of the country from 2002 onwards, provided that the emissions from the process agent applications are consistent with the levels agreed by the Executive Committee.

Owing to misunderstanding in the communication between A and B, B granted A the right to disclose information Y only yet A believed that B granted him the right to disclose information X. If A disclosed information X and was charged with an offence under clause 126, to rely on sub-clause 5, A would need to prove that among other things, he believed B had granted him the right to disclose information X.

In relation to proposed section 72K(2)(a)(x) which stipulated that the local manufacturer applying for an export compulsory licence should provide any other information as the Director might reasonably require for the purpose of granting such licence, Mr WONG Ting-kwong asked and the Administration explained that this provision was to cater for unforeseeable circumstances which made the provision of information other than those covered in proposed section 72K(2)(a)(i) to (ix) necessary.

Clause 11 of the Bill proposes to add sections 67(2A) and 67(2B) to the effect that at the end of the trial of an election petition that relates to the inclusion of the name of a person in, or the exclusion of the name of a person from a precedence list, CFI must determine whether the name is to be included in the list, and at the end of the trial of an election petition that relates to the ranking of a person on a precedence list, CFI must determine whether the ranking of the person on the list is correct and, if not correct, what is the correct ranking.
