It encouraged the Vietnamese to pursue universal values in their own way and not to impose formulas that had many limitations.

(E) Where arrangements are under consideration concerning the appointment (including the arrangement or variation of the terms thereof, or the termination thereof) of two or more Directors to offices or places of profit with the Company or any other company in which the Company is interested, a separate resolution may be put in relation to each Director and in such case each of the Directors concerned shall be entitled to vote (and be counted in the quorum) in respect of each resolution except that concerning his own appointment (or the arrangement or variation of the terms thereof, or the termination thereof) and except (in the case of an office or place of profit with any such other company as aforesaid) where the other company is a company in which the Director together with any of his associates owns five (5) per cent or more of the issued shares of any class of the equity share capital of such company or of the voting rights of any class of shares of such company.

The major challenge encountered in this process has been how to maintain UNESCO’s specificity, hence strength, as a specialized agency with its complex composites of intergovernmental committees with its own political and technical agendas in the promotion of international conventions, normative and standard-setting programmes to serve as exemplars in addressing major global issues in the fields of competence of the Organization.

They cover controls of hand held percussion breakers; increases in penalties and improvements in the procedure for abatement notices to air pollution offences; controls on the use of asbestos; controls on the use and maintenance of waste treatment plants, provision to direct property owners to discharge wastes into public sewers; for a system of charging for treating of industrial effluent to specified quality and regulations to control the disposal of chemical waste and charge for it.

Section II, title X, article 328 of the Family Code states: “When the health, safety, morality or education of a minor are jeopardized or insufficiently protected owing to the immoral behaviour or disability of the father and mother or of the person accorded the right of guardianship, or when, owing to misconduct or unruly behaviour, a minor gives these individuals cause for very serious dissatisfaction or renders them incapable of exercising guidance, the juvenile judge may on his own initiative, at the behest of the public prosecutor or at the behest of the father, mother or guardian, rule that the minor shall, for a period not to extend beyond the date of his coming of age, be visited regularly by a social worker or placed on probation.

The overall aim of the Integrated Strategic Framework for the Democratic Republic of the Congo is: (a) to forge a shared vision of how the United Nations can assist the Government and the people of the Democratic Republic of the Congo to end the long-lasting conflicts in the eastern part of the country, to consolidate peace in other areas, and to accelerate nationally the process of recovery and development; (b) to translate this vision into a single, coherent strategic framework that has clear objectives and priorities, taking full account of the Government’s own goals as reflected in the poverty reduction strategy and its priority action plan, and the Stabilization and Reconstruction Plan for eastern Democratic Republic of the Congo; and (c) to strengthen United Nations coordination and management mechanisms to ensure the cohesive implementation of priorities in keeping with the principle of “delivering as one”.

MRLs of these pesticides in different food commodities are then established based on the residue data obtained from individual countries’ own supervised field trials or provided by the industry.

(iv) Any security interest referred to in subparagraph (i), (ii) or (iii) and which extends to future advances or liabilities shall, on and from the appointed day, be available to Bank of East Asia (whether for its own benefit or, as the case may be, for the benefit of any other person) as security for the payment or discharge of future advances and liabilities to the same extent and in the same manner in all respects as future advances by, or liabilities to, First Pacific Bank or, as the case may be, Bank of East Asia were secured thereby immediately before that day.

Taking into consideration its own comments in paragraph X.16 above, the Committee is of the view that any additional requirements for the implementation of the web-based follow-up system should be met from a more rational utilization of resources under staff travel and consultants, as well as contributions from member organizations.

Proposed section 36(1A) provides that every hearing of the Disciplinary Committee shall be held in public unless on its own motion or on application of the complainant or the certified professional accountant (CPA) concerned, the Disciplinary Committee determines that in the interests of justice a hearing or any part thereof shall not be held in public.

Many Member States called for a continuation of the mainstreaming approach of the 32 C/5 in the 33 C/5 as well, emphasizing however the need for more focused activities, particularly in favour of women and youth in LDCs, as well as for closer linkages with other United Nations agencies, MDGs and UNESCO’s own strategic objectives.

These include, but are not limited to, talented young voices giving expression, through word and image, to their expectations of the Organization and those who lead its Member States; scholars, students and teachers who see in their work a discernible United Nations “impact”; college students who adapt the dynamism of the General Assembly’s possibilities to a “Global Model United Nations” that is entirely their own; non-governmental organizations and individuals who breathe new life into long-debated topics with the vigour of a vaster geographical base and greater opportunities for participation; Governments, research institutions and the media, which seek, and can now find, the recorded positions of Member States on key issues in readily accessible form; and the creative community, which sees in matters vital to the Organization’s agenda the chance to reach its audiences in a fashion that informs as it entertains.

Waste management forms a part of private sector economic activities, with the state owning just the three hazardous waste collection centres and local governments owning several regional waste management centres – the main part of waste collection, sorting, recovery, etc. takes place in the private sector.

They must also participate in common activities for occupational safety with the aim not to endanger with their activities their own life and health or that of others present at the workplace.

The Committee reiterates its previous recommendation (CAT/C/FRA/CO/3, para. 20) whereby compliance with the provisions of article 12 of the Convention requires a derogation from the system of discretionary prosecution, so as to oblige the competent authorities to launch impartial inquiries systematically and on their own initiative wherever there are reasonable grounds for believing that an act of torture has been committed in any territory under its jurisdiction, in order to effectively ensure that the perpetrators of such crimes do not remain unpunished.

The Dispute Tribunal may at any time, either on an application of a party or on its own initiative, issue any order or give any direction which appears to a judge to be appropriate for the fair and expeditious disposal of the case and to do justice to the parties.

The computer software industry is also a highly important source of innovation in its own right and its members argue that they have produced dramatic gains in the performance and functionality of many commercial software products in the last decade or so while prices have remained stable or even fallen.

The Programme of Action sets a broad agenda for the improvement of the status of women, stressing the importance of increasing their equal participation and equitable representation at all levels of the political process; improving women’s ability to earn an income in varied occupations so that they can become economically self-reliant, ensuring their equal access to the labour market and social security, and ensuring their equal rights to buy, hold and sell property and land, to obtain credit and negotiate contracts in their own name, and to exercise their right to inheritance (paras. 4.4 and 4.6).

(b) To carry on all or any of the businesses of shipowners, ships agents, ship brokers, insurance brokers, managers of ships and shipping property, freight contractors, carriers by land and sea, barge owners, lightermen, stevedores, ship repairers, ship builders, ship breakers, ship suppliers, salvage and towage contractors, engineers in all its branches, forwarding agents, refrigerating storekeepers, warehousemen and wharves and godowns and to conduct road haulage and lighterage business of all kinds.

May be evacuated with a subsequent offer of another living space: (i) workers and servants (along with the persons that live with them) that have discontinued their employment relations with the enterprises, institutions, organisations of the most important branches of the national economy, which offered them the living space, as a result of own initiative discontinuation of the employment relations without justified reasons, or which have been dismissed for breaching the employment discipline or as a result of an offence; (ii) citizens that have received living spaces in the houses of collective farms, if they have been excluded from the collective farm as a result of their own initiative; (iii) citizens that have been deprived of their parental rights, if they live together with their children in relation to whom they were deprived of their parental rights; (iv) parents-adopters, if they have been deprived of the education of the children; (v) other cases.

The Chairman (if any) of the Board or, if he is absent or declines to take the chair at such meeting, the Deputy Chairman (if any) shall take the chair at every general meeting, or, if there be no such Chairman or Deputy Chairman, or, if at any general meeting neither of such Chairman or Deputy Chairman is present within fifteen minutes after the time appointed for holding such meeting, or both such persons decline to take the chair at such meeting, the Board present shall choose one of their number as Chairman, and if no Director be present, or if all the Board present decline to take the chair, or if the Chairman chosen shall retire from the chair, then the members present shall choose one of their own number to be Chairman.

The following table demonstrates the sensitivity at the balance sheet date to a reasonably possible change in the US$ exchange rate, with all other variables held constant, of the Group’s profit before tax (due to change in the fair value of monetary assets and liabilities) and the Group’s owners’ equity.

The subparagraph should thus read: “Designing, revising and implementing laws to ensure that rural women are accorded full and equal rights to own and lease land and other property, including through the right to inheritance, and undertaking administrative reforms and all necessary measures to give women the same right as men to credit, capital, appropriate technologies and access to markets and information”.

By contrast, it might also be argued that intellectual property owners and licensors could achieve an equivalent result by ensuring that they or their secured creditors: (a) obtained a security right in or an outright assignment of a right to payment of a percentage of the sub-royalties payable to the licensee as a sub-licensor by sub-licensees and registered a notice thereof in the relevant intellectual property registry before any registration in that registry by a secured creditor of the licensee; (b) obtained a security right in or an outright assignment of a right to payment of a percentage of the sub-royalties payable to the licensee as a sub-licensor by sub-licensees and registered first a notice thereof in the general security rights registry; or (c) obtained a subordination agreement from the secured creditor of the licensee.
