(h) On the draft proposed CSA to Order 47 of the Rules of the District Court (Cap. 336H) set out in section 111 of Schedule 2 to the Bill (page 168 of LC Paper No. CB(1)2109/03-04(02)), the Administration confirmed that as in the case of Order 47 of the Rules of the High Court (Cap. 4A) (item 21 of the list of follow-up actions to be taken by the Administration arising from the thirty-fifth meeting of the Bills Committee on 11 June 2004), the expression “shall be taken and deemed to be a valid transfer of such right, title and interest and” would be deleted from rule 7(4)(b) of Order 47.

Clause 11 of the Bill proposes to add sections 67(2A) and 67(2B) to the effect that at the end of the trial of an election petition that relates to the inclusion of the name of a person in, or the exclusion of the name of a person from a precedence list, CFI must determine whether the name is to be included in the list, and at the end of the trial of an election petition that relates to the ranking of a person on a precedence list, CFI must determine whether the ranking of the person on the list is correct and, if not correct, what is the correct ranking.

L.N. 39 amends Schedule 1 to the Trade Descriptions Ordinance (Cap. 362) (the Ordinance) to add the Free Trade Agreement between Hong Kong, China and Chile signed on 7 September 2012 (the Agreement) to the list of scheduled trade arrangements so that, by virtue of section 2A(3) of the Ordinance, the rules of origin for any goods qualified for preferential tariff treatment under the Agreement apply for the purpose of determining the place of manufacture or production of the goods.

This legislation provides for universal jurisdiction over any or a combination of thefollowing:(a) grave breaches of the Geneva Conventions and Additional Protocol I thereto (primarily States members of the Commonwealth); (b) crimes specified under the Second Protocol to the 1954 Hague Convention and the International Convention for the Protection of All Persons from Enforced Disappearance (for example, Cyprus, Japan and the Netherlands); (c) other violations of international humanitarian law where no treaty requires universal jurisdiction, such as war crimes committed in non-international armed conflict (Belgium, Canada, New Zealand and the Philippines) and violations of treaties that either prohibit or regulate the use of certain weapons (South Africa); (d) the war crimes list contained in article 8 of the Rome Statute (Belgium, Canada, Germany, New Zealand and the United Kingdom).

a) To define “pesticide” and other related terms in a way consistent with Codex; b) To provide a list of maximum residue limits (MRLs) and extraneous maximum residue limits (EMRLs), to adopt MRLs/EMRLs recommended by Codex as the backbone as well as the Codex’s classification of foods; c) To prohibit the import and sale of the concerned food for which no MRL/EMRL had been specified, unless DFEH was satisfied that the detected level would not be dangerous or prejudicial to health; d) To provide a list of exempted substances; e) To accept applications for adding / revising MRLs and exempted substances; f) To dovetail the proposed Regulation with the registration of pesticides for use on food crops under the PO, Cap. 133; and g) To commence the proposed Regulation after a two-year grace period.
