专利，即专利权的简称，主要分为发明、实用新型及工业设计三种类型。各国政府设立专利制度，其目的在于鼓励民众从事发明，保护发明人（或其受让人或继承人）的权利，并指导专利权人与民众以合法、适当的方式利用发明，以促进产业发展。专利制度是让专利权人在法定期间（例如：20年）内享有专利技术的排他权（注意，并非独占权），使其享有商业上的特权利益，以鼓励其将知识公开分享。当专利权法定期间届满，专利权即告消灭，民众即可根据专利说明书所揭露的内容，自由运用其专利技术。
