The Delegation did not see how a member could not be in agreement with this as an important objective of the cooperation rendered by WIPO.

WIPO as an international intergovernmental organization is answerable to its Member States and its existence depends on its Members only.

IPN was concerned with a number of specific proposals that appeared to unjustifiably draw WIPO away from its core responsibilities.

It did not consider it as a focal issue of IP and therefore should not be posed as a priority area for WIPO.

There was no need to revise or to go beyond the existing WIPO mandate to achieve those desirable goals.

The Delegation concluded by referring to the constitution of a WIPO Trust Fund to which Spain would be fully committed.

WIPO, with its worldwide database on the PCT, could make a good contribution by stating clearly what inventions were in the public domain.

It believed that WIPO was one of the appropriate fora, where such issues could be addressed.

On the matter of funding, the Delegation indicated that WIPO was financing studies of that type.

However, it also said it had a number of concerns regarding the establishment of an evaluation and research office as proposed.

The Delegation reiterated that it did not think that necessary conditions existed to enter into a debate on amending the WIPO Convention.

He pointed out that of the current 183 WIPO Member States, as many as 21 had not even ratified the Berne Convention.

That was why the Delegation was pleased to see that WIPO had taken up the challenge, in the previous years.

The Delegation also proposed the creation of a WIPO office for assessment and evaluation (WERO) that would depend on the General Assembly.

It had to be decided whether WIPO was to be part of the solution in reforming the global IP system or be a problem in the global IP system.

Regarding human resources, one of the recommendations of the JIU was that WIPO should develop a comprehensive HR strategy.

It believed that was a situation which had to be balanced properly, under a revision of the norm-setting activities in WIPO.

Regarding the WIPO Development Agenda, the Delegation regretted that agreement had not been reached on this issue during the past two years.

It believed that amending the WIPO Convention would be a long term process and was the ultimate objective of Member States.

It said it would not object to WIPO's initiative for trying to make contracts with private companies which had commercial databases.

In light of that, the Delegation urged WIPO to regard this flaw in the system and consider a possible solution.

It was crucial that WIPO programs did not de-jure or de-facto mandate any of these activities in favor of proprietary software.

There was no doubt that the entire membership of WIPO had taken ownership of the work of the PCDA.

As it had stated in the discussions on the Development Agenda, development was already a strong and undeniable dimension of WIPO.

On the other sections, the Delegation did not consider setting up a new WIPO committee to be a good idea.

The geographical balance within WIPO should also be part of that desire for inclusion and participation in the Organization.

Given WIPO's limited resources, the Delegation did not support duplicating work already underway in other international organizations.

It explained that it did not mean that they underestimated what WIPO could do on the subject.

The Delegation wished to highlight the following activities that WIPO had continued to support in its country.

In the Delegation's view, a WIPO Development Agenda was something that had to be implemented through a gradual approach.

The Delegation said that open standards was the need of the day, and that it would request WIPO to take up that issue.

The work of these two bodies was vital and WIPO should ensure that they received adequate resources to carry out their responsibilities.

It expressed the view that the committee would be able to make clear recommendations to the following WIPO General Assembly.

The Delegation thought there was a real positive impact that might derive from WIPO actually adopting a clearer course in this direction.

A study of that nature was being implemented in Tanzania with the assistance of WIPO , for which the Delegation was very grateful .

The long- term objective of the PCDA was to establish a mainstream development agenda in WIPO on a permanent and sustained basis .

WIPO, a UN organisation, set up a committee dedicated to implementing the proposals and it was agreed they would meet twice a year.

It was more than clear that WIPO had already integrated the development dimension in its activities.

The group appreciated the efforts made by WIPO and the progress which had been made.

The Delegation said that the last part of its proposal dealt with a plan of action for development within WIPO.

The European Union was also pleased to see activities undertaken by WIPO in the area of research, funded by public funds .

Those principles should constitute the basis of any future activities undertaken for technical assistance and cooperation by WIPO.

The Delegation felt that the proposals fell within the efforts already made to draw up a plan of action for WIPO for development.

One was the emphasis on the fact that other regions of WIPO had to be included.

The Delegation said that the issue of norm-setting within WIPO was a core element of its proposal for a development agenda.

The Delegation of El Salvador congratulated WIPO and its membership on the adoption of the Singapore Treaty on the Law of Trademarks .

Therefore , it did not think it was necessary to amend the WIPO Convention to include explicit language on the development dimension .

The Secretariat estimated that this exposed WIPO to a currency loss or gain of 10 million Swiss francs per year.

It added that discussions were now taking place in WIPO to consider new rights and also to extend the term of protection.

It expressed its appreciation for the work of the Secretariat and of the Director General of WIPO in the area of IP and development.

The Delegation pointed out that there was a great room for improvement in the way those assessments were usually dealt by WIPO.

That was the reason why , on behalf of the LDCs , the Delegation had proposed the establishment of a Trust Fund within WIPO .

The Delegation thought that it was important that WIPO continued to devote substantial funding for those activities in the future .

In particular, it had already committed itself to promoting the Millennium Development Goals, which was something fundamental.

In addition, a number of WIPO meetings had electronic forums where input could be obtained on an ongoing basis from some of those groups.

The Delegation pointed out that no single Member State of WIPO had expressed its opposition to the adoption of a Development Agenda.

The Delegation stated that it would have been much nicer to have the support from WIPO itself.

That program took place with the help and support of WIPO, and soon, in a month, there would be a post-graduate program.

It was up to WIPO to address the issue of public domain as a revised standard.

The Delegation said that they should attempt to determine what proposals could gain the broad support of WIPO's membership.

The number of ad hoc members of the WIPO Coordination Committee to be designated by the WIPO Conference is thus two.

The WIPO secretariat is assisting the WHO secretariat to help clarify relevant technical patent-related issues raised by the debate.

With the approval of the General Assembly, these proposals will now be implemented immediately by WIPO.

It also paid tribute to the outgoing Deputy Directors General and looked forward to cooperate with the new management team.

That information would form part of a larger database, which would be accessible on the WIPO website.

Therefore it did not support any position that emphasized technical assistance as the "Development Agenda for WIPO" .

The Delegation wondered that if WIPO was not the forum, which other forum would be there to address such issues.

It would need to be accompanied by a comprehensive attempt by WIPO to enhance public accountability and participation .

The Delegation of Australia expressed their appreciation for all the proposals put forward on the topic of a Development Agenda for WIPO .

Also , that the project to automate the Patent Office would be completed very soon with the financial and technical assistance of WIPO .

It believed that WIPO's technical assistance activities and the content of its programs must be balanced and development oriented.

As part of the conference WIPO awards had been given for invention-related and rationalization activities.

Figures for other possible means of viewing and downloading priority documents from WIPO's website via the Internet are not available.

Further consideration of the envisioned role of WIPO and the individual Member States in conducting such impact assessments would be needed.

WIPO demonstrated a commitment to development and a great foresight in setting up the PCIPD.

IP Australia had been working with WIPO to develop the capacity of Pacific Island countries to develop new IP and administration systems.

The United States believes that it is useful to expand and elaborate upon our original proposal to establish a WIPO Partnership Program.

WIPO has adopted a set of information management guidelines that serve as the basis for its relationship with users.

The global protection systems which contribute significantly to WIPO's income are systems that have been created by Member States.

The Delegation said that it was not certain that it was common for every committee to submit its report to the WIPO Conference or Assembly.

WIPO approved the creation of a new committee to implement the 45 proposals, which will meet twice in the next year.

She therefore wished to see the WIPO Development Agenda continued.

This Treaty shall be open for signature until. By any Member State of WIPO and by the European Community.

The Delegation reiterated the importance of the issue and considered that it should be a standing item on the work agenda of WIPO .

It wished to see it become a regular practice in WIPO.

To submit appropriate recommendations on their implementation to the next WIPO General.

A filing under Wipo's patent co-operation treaty enables inventors to apply for patent protection in up to 138 countries.

There were also many other areas where WIPO should address over-reaching in terms of intellectual property rights.

The Delegation also thanked WIPO for the participation of its officials in the seminar on exceptions and limits to copyright.

To this end, it welcomed the establishment of the WIPO Audit Committee whose membership included two African states, Nigeria and Togo.

It emphasized that in everyone's mind their endeavors to establish a development agenda for WIPO would have to continue and must continue.

WIPO supports its Member States by providing capacity building programs and serving as a discussion forum on technology transfer topics.

To strengthen WIPO's internal evaluation function, the drafting of a WIPO Evaluation Policy is currently under way.

WIPO had critical work to do, including norm-setting and assisting countries to gain full advantage of the IP system.

The Delegation further stated that it was important that such work was well targeted and coordinated with WIPO efforts.

With regard to WIPO's technical assistance, it said that it should not be limited to countries coming from the African Group.

The Delegation said that there should be more interaction between the Convention on Biological Diversity ( CBD ) and WIPO .

Finally, the Delegation assured WIPO of its continued support to the Organization as well as to individual Member States.

The Delegation also requested to have the results of specific studies undertaken by WIPO in different countries of the world.

The Delegation believed that competition policies were issues, which should be dealt with by another international organization, not WIPO.

WIPO's International Bureau would maintain the web site and Partnership Database and facilitate partnering through the Partnership Office.

It therefore, asked WIPO to address these important issues through a treaty on access of information and knowledge.

The Representative pointed that the mandate for the Development Agenda agreed by the WIPO General Assembly had been quite clear.

WIPO technical assistance programs are extended to all countries, including those, which are not members of the Organization.

WIPO needed greater transparency of processes and stronger governance to be run efficiently.

In this respect, the EC and its Member States had strongly supported the establishment of the WIPO Audit Committee.

The Delegation believed that WIPO had considered, and should continue to consider, the importance of the public domain and its work.

It assumed that it was not the intention of WIPO to declare copyright in general outside the scope.

Firstly, to ensure greater participation in civil society in WIPO's activities and, secondly, to strengthen its character as a UN Agency.

Looking at those questions, the Delegation could support the idea of having an independent WIPO evaluation and research office.

In the seminars, meetings and conferences , in and outside of WIPO, the discussion by Member States has been enriched and broadened .

Some had asked for assurances that the WIPO Partnership Program would be driven by Member States.

We believe that the effects of this proposal will significantly improve the way that WIPO looks at IP and development.

WIPO could clarify what was required by the TRIPS Agreement in the area of data protection.

Copies of that report were communicated to each Member State of WIPO, of the Paris Union, or the Berne Union on July 31, 2006.

It said that the second proposal required more careful examination and did not think that an additional burden should be imposed on WIPO.

The WIPO patent agenda was one such example.

WIPO also participates in the work of the WHO Commission on Intellectual Property Rights, Innovation and Public Health.

Meanwhile, WIPO had finished several reference projects in Europe (Germany, Switzerland).

The Representative also supported the proposals for increased NGO participation and transparency in WIPO's role and creation of new norms.

Instruments of ratification or accession must be deposited with the Director General of WIPO.

The Delegation thanked the WIPO for the excellent documents presented for the meeting.

Another proposal was to create a system within WIPO to enable countries to seek reports and analysis.

It urged WIPO to be pro-active in assisting in the implementation of the Doha Declaration.

The Delegation reiterated its commitment to the idea of a Development Agenda for WIPO.

At present, the WIPO Secretariat had already taken on a very heavy workload.

In that regard, it was encouraged to note the inclusion of some of its comments to WIPO in the document.

It believed it was outside of WIPO's mandate to involve itself , for instance, in competition policy or bridging the digital divide .

The already substantive and multifaceted ASEAN-WIPO cooperation had extended into various areas of IP involving a multitude of stakeholders.

The conceptual approach at WIPO that equated right- holder groups with public interest organizations still presented problems .

Furthermore, the cooperation received from WIPO had helped to achieve very positive results despite the financial restrictions.

The Delegation had suggested those in the last two sessions of the WIPO Assembly.

To separate the norm-setting functions of the WIPO Secretariat from those of technical assistance.

The Director General responded that WIPO would certainly engage and push, to echo the prudent words of the Delegation of Brazil.

More transparency, discipline and efficiency had been brought in WIPO's work.

The Representative urged WIPO to request Member States to extend such invitations and IFLAI would be pleased to assist in that regard.

It was concerned that the negotiation on amendments to the WIPO Convention could postpone progress on other aspects of development issues.

The Delegation said that it believed WIPO should continue its cooperation with other partners in promoting development.

The Delegation recalled that a few days earlier the Group of 77 had appealed to WIPO to have a plan of action for development.

The Delegation thanked WIPO for its support and congratulated WIPO and its Worldwide Academy.

One way that WIPO advances economic, social and cultural development is through its development cooperation activities.

The Delegation insisted that should be kept in mind in planning and implementing WIPO's technical assistance for grants.

WIPO develops a wide range of activities targeting SMEs in the scientific research and cultural industries.

Extending efforts to reinforce specific intellectual property laws, Romania would continue to cooperate with WIPO.

The Delegation expressed the view that they still needed to further improve the work of WIPO in the area of development.

The Representative representing library associations accredited to WIPO played an active part and wished to work actively in the PCDA.

The WIPO Partnership Program would facilitate practical, concrete achievements.

All proposals received from Member States had confirmed the necessity of development within WIPO with different approaches.

The Delegation also supported the proposal for WIPO to publish guides for studying the intellectual property situation in each country.

To expand WIPO's advice and technical assistance provided to SMEs and sectors dealing with scientific research and cultural industries.

And that the Office's internal Patent system was directly connected to WIPO's Global PatentScope system, which was now in daily use.

The Delegation was of the opinion that to strengthen this role, there were issues that WIPO should tackle.

It wished, therefore, to caution against any reliance on extra-budgetary resources for cooperation activities within WIPO.

In 2008, Huawei registered more patents than any other company, according to Wipo, the global patent office.

It believed that there was need to consider ways to further improve the quality of WIPO's services.

Therefore, it believed that the WIPO mandate should not be changed.

The Representative focused on the crucial role played by WIPO both in CISAC as well as its members'activities.

The Delegation added that Austria also actively supported WIPO's role as a promoter of IP awareness.

It would be useful to examine, under that sector, how to strengthen WIPO's activities to better meet their needs.

The Delegation made a reference to several proposals, which could not be dealt within WIPO's mandate.

Expansion of the WIPO Arbitration and Mediation Center's services to include a wider range of IP disputes.

Good governance was important for the efficient running of all international organizations including WIPO.

The Delegation invited Member States to consult a completed module in the WIPO lobby during the Assemblies.

WIPO's Member States determine the strategic direction and activities of the Organization.

It said that delegations had been excited about the prospect of developing a new Development Agenda for WIPO.

The Delegation said that it expected such cooperation activities as Government of Japan engaged in to prevail in WIPO.

Finally, the Delegation looked forward to continued fruitful cooperation between Ukraine and WIPO.

In the area of training, many officials had benefited from training courses organized at WIPO Headquarters or in other countries.

The role played by WIPO had been of great importance to Sudan.

The documents reflected the areas, the volume and the forms of technical assistance in which WIPO was involved.

DMCA Title I, the WIPO Copyright and Performances and Phonograms Treaties Implementation Act has two major portions.
