Within the European Union, the EU arbitration Convention provides for arbitration of unresolved transfer pricing cases between EU countries.

The arbitrator or arbitration tribunal shall apply the rules of this Convention.

The initiation of the present arbitration by the Philippines is an abuse of the compulsory dispute settlement procedures under the Convention.
