However, if this Law does not deem it a crime or imposes a lighterpunishment, this Law shall apply.

In the Criminal Law of China, article 29 , section 2 states:"provided the person is not guilty of the instigated crime, the instigator may be punished less severely or with a lighterpunishment".
我国刑法第2 9条第2款规定：“如果被教唆的人没有犯被教唆的罪，对于教唆犯，可以从轻或减轻处罚。”

If the instigated person has not committed the instigated crime, the instigator may be given a lighter or mitigated punishment.
